enforcement 的问题（已经回答）

请教大律师，租客欠租后我们诉至TRIBUNAL 审理判决后，租客完全无视审判结果，我们于是交由ENFORCEMENT 追账，现在快一个月过去了，这个ENFORCEMENT 能说的就是他们找不到这个租客，打电话不接，邮件不回，短信不回，看起来好像感觉这新西兰法庭的判决形同废纸，这个强制执行部门也好像啥也干不了，不知该咋办了。新西兰的法律真的是这么无能，无尊严吗？困惑。

谢谢大律师回复。 第一期的判决是欠租$2000多，正在等待第二期的审理，第二期会有欠租和房屋损坏的赔偿。您说的这两个方式能解释下具体是什么，费用方面是怎样的？谢谢！

For debt of $1000. you can start a bankruptcy proceeding.

If the person has a proper job, he will jump up from his couch and pay you.

If you can't find him, no worries, apply for substituted service such as newspaper advertisement, or his last known address (both) or his parent's address that is likely to bring to his attention or service on the case manager of Social welfare who is likely to bring to his/her attention. (You need to set up your reasons why you think those methods are good to bring to his/her attention of your bankruptcy)

After that, file proof of service.

On the day of the hearing, produce those filed documents, and the judge will look at the file and make sure the documents are served.

If everything looks okay, the judge will declare him/her bankrupt. You seal a bankruptcy order at the Registry office.

Hang that court order on your wall and be jolly proud of it.

All these can be DIY if your English is fine.

Thank you for your reply. Can you explain how making him bankrupt will help me, it seems that if he is bankrupt he will not need to pay the debt anymore. also he does not look like he has a job at the moment, he had a job when he came to rent. Thanks again.

Bankruptcy is a strategy to use.

It is like showing a person a coffin and ask him to make a choice.

If a person is a thinking person, he will choose to pay back rather than to face bankruptcy. eg, who would want to employ a bankrupt? who wants to date a bankrupt? who wants to lend money to a bankrupt? If a person still does not want to pay you, basically it is hopeless, and you don't mind burning more money to get a final satisfaction.


In a digital world, everything is searchable, and if a person is willing to gamble a debt of $2000 for his future, so be it.
