thanks, where can i find more info on this?
You can talk to the law society first to first lodge a complaint on the service level provided by the lawyer. This is pure carelessness ( negligent).
having a meeting is not an excuse, the 5pm dateline is to be observed. If the lawyer don't reply and confirm unconditionally by 5pm on that day, the agreement will be and can be cancelled especially on the hot property market.
Depending on how comfortable you are dealing with her now, she might talk you down (like the people here) and tell you to look for another property. This type of negligent is normally covered by the lawyer's insurance.
Communication with your lawyer can be verbal, text or email, or phone or wechat, whatapp etc. There is no fixed rule unless it is specifically specified.
An experienced lawyer will normally call you or ask her assistant to call you (and ask you to put in writing) on the day or the day before the conditional date and she will dutifully inform the seller lawyer before 5 pm on the due date. This is likely not happening and completely forgotten by your lawyer and she only realized it after 5 pm or received a fax or email (from the seller's lawyer) to say it has been canceled. She probably panicked and think of an excuse.
You need to be bold if you want to take it further. Negligent claim limitation period is 6 years (not so sure)*, you will need to talk to someone who may assist you to make a claim.
*the limitation period for contract or tort claims is six years “from the date on which the cause of action accrued” (website).
