A tenant whose landlord withheld her bond because she would not get the carpets professionally cleaned says more renters should know their rights.
Kelly Hannifin had rented a central Christchurch flat for more than two years when she shifted out at the end of April.
The landlord, Whittle Knight and Boatwood Estate Agents, wanted to take a carpet cleaning fee of $90 from her bond and withheld the entire $840 while the matter went to the Tenancy Tribunal.
She had asked that they only withhold the cleaning amount and release the remaining $750 because it was money she was relying on.
But Hannifin said she was told the landlord wanted to enforce the request for cleaning because the carpets were not as clean as when the tenancy started.
"I do not think it is reasonable to think that carpet will be the same at the end of the tenancy. There is always going to be wear and tear over the course of two-and-a-half years."
The case was not resolved until June when the tribunal sided with Hannifin and told the landlord to repay the bond plus a filing fee. "The landlord has not satisfied me that the tenant failed to leave the lounge carpet reasonably clean. She was not required to leave the carpet in a state where the premises could be immediately rented again. Landlords must expect to have to do some cleaning between tenancies," its judgement said.
Hannifin said she had not realised at first that she could not be required to pay for a professional carpet clean.
But she rang Tenancy Services and was told the only enforceable requirement was for the property to be left reasonably clean and tidy.
"I'm a clean and tidy person, every three-monthly inspection has been very good or excellent," she said. "I paid them $30,000 of my own money in rent and they wouldn't release my $750."
Bindi Norwell, chief executive of the Real Estate Institute, said carpet cleaning had to be addressed on a case-by-case basis and an automatic carpet cleaning clause in contracts was not enforceable.
