一个投资房，邻居是个学校，没有和我们达成协议就做了fence,现在要求我支付一半的费用，价格90刀一米，有人知道有关邻居fence必须要share吗？而且没有给我任何报价。我没有答应做。

90一米？还是共同摊钱！这么贵！什么fence?不用理他，没有法律规定你一定要摊钱！摊钱不摊钱纯粹是本着自愿原则！

我家隔壁造房子，有一天跑过来跟我说要修新fance，可能要用一下我家driveway，还很客气，他们出钱，只是背面对着我们。不用出钱我也无所谓。
你还不如直接告学校，没经过你同意就把原来的fance拆了。

不用争，陈述事实，他们没经过你同意就把fence做了， ok, thank you very much, but I don't need it and please remove it.

仲裁法庭一定判你赢，除非学校能证明他们找过你并且你同意付款。

谢谢了，我在他们做FENCE之前的确没有任何人通知我，去年我在中国住了半年，接到过管理公司的邮件说做了FENCE,我当时就告诉管理公司，我不同意做，今年年初管理公司转来两个邮件，是学校要我们付钱的通知，我告诉管理公司不理他们。这周收到管理公司转来上法庭的通知，我才知道学校在做之前的二十一天通知过管理公司，而管理公司告知学校邮件丢了。这些都写在学校的诉词上。我并不需要赖账，但是47米的FENCE要4400，我要负担一半，有点价钱离谱，只是没有在新西兰打官司的经验，觉的这事挺不合理。没有我的任何协商，我没有见到任何人都报价他们就做了，挺霸道，看看周五法院怎么说吧，主要想了解法律有规定必须要SHARE这笔费用吗

新西兰遵循公平，平等，什么都讲人权，这种恶意收费完全是无理由的。

跟你的物业管理公司沟通好，确认他们没有漏掉过重要邮件才最重要，别让中介公司给你搞砸了

这里的法律是这样的，邻居要在你们的交界建FENCE，你必须出一半的钱。
首先，我认为你的管理公司疏忽了，应该追究他的责任。
其次，你能做的可能就是尽量减少你要伏的FENCE 费。具体操作大概有你找个专业做FENCE的给你一个报价，肯定是要比这个学校低的。这样就算你付一半也没4470那么多。 其次，提供你不在这里的证明，说明你不是有意忽视学校的 NOTICE的。 还有能帮你的就是收入证明，证明你无力承担这么多钱。

看来他们的确在做栅栏之前就给过你FENCING NOTICE了。但是如果在你们之前还存在OUTSTANDING DIFFERENCES时，他们仍然做了栅栏，本该是无效的。现在就看DISPUTES TRIBUNAL如何审判你们之间的歧义了。不过这47米栅栏都是你家和学校之间的么,好长的一段距离啊。 等你更新。

就算交界没有fence，那也要双方同意才能开始做吧？
不可能单方面做完后直接发invoice。

给你提个醒， 要发FENCING NOTICE等对方回复了或21天后 再做栅栏。一切先斩后奏恐怕都不算数。

谢谢大家，我去管理公司问了，他们没有收到，或者丢失了通知做Fence 的邮件，所以没有通知我，而且以前和学校之间有一部分fence,学校说有危险会伤到学生给拆了，拆时问过租客。租客说他们不介意。投资房，我基本没去过，一直交给公司管。周五开庭，我叫了翻译，不付钱恐怕不可能了，会力争少付点吧，分它两年付吧。

不是必须分担的。
对方未经你同意就做了是他们的事。
如果对方要做fence你不同意的话不行的，如果他们一定要做你还可以要对方根据你的要求做。

我们鄰居做了fence我们同意了都没有要我们给钱。他正后面的那家就是要他们根据他们的要求才可做的，钱还不是share的，后面的那家一分都没给。

How do I get my neighbour to share the cost of a fence?
First talk to your neighbour to see if they will agree to sharing the costs of the work.
If your neighbour doesn’t agree to this, there’s a formal process you can follow, set out in the Fencing Act 1978, to require your neighbour to contribute. You start this process by giving your neighbour a “Fencing Notice”.


What if my neighbour doesn’t reply to my Fencing Notice?If your neighbour doesn’t send you a Cross-Notice within 21 days after getting your Fencing Notice, the law assumes that they agree with the proposals in your Fencing Notice. You can then begin work on the fence and recover the cost from your neighbour, as set out in your Fencing Notice.

When can I start work on the fence?You can start work on the fence:

• 21 days after you gave your neighbour the Fencing Notice, if they haven’t responded with a Cross-Notice by that time, or
• if they’ve given you a Cross-Notice, as soon as the differences are resolved by agreement or by the Dispute Tribunal or the courts.
  

Your neighbour doesn’t have to contribute to the cost of any work you do before this time.


Sample Fencing NoticeYour Fencing Notice doesn’t have to follow this sample exactly. It is a guide to the type of information that must be included.

Please take notice that I desire that a/the fence be erected/repaired between your property and my adjoining property at [address] in accordance with the following particulars:

• Further description of the boundary to be fenced.
• Type of fence [if desired specify one of the specimen fences in the Second Schedule to the Fencing Act 1978, or specify any other type desired].
• Method of construction [for example, by a contractor, or by one or both neighbours].

学校不傻。。这个收费步骤完全合理合法的，而且当时的“Fencing Notice”里应该包括报价单了。估计是楼主的物业管理公司疏忽了。

而且用“没收到信”根本不是理由，很多法律通知根本就不管你有没有收到。

今天开庭了，围绕这第一封fence 通知展开，学校方无法证明在做fence前将通知给我，他们只是说寄出了通知，没有我和管理公司收到的确认。另外，我实地测量，fence 只有44m，fence板用的是19mm 而报价单是47m, fence 板是25mm , 所以学校有欺诈行为。我比较有信心能赢。谢谢各位了，两周内法官会有判决。
