A safety barrier required on a retaining wall with a fall greater than 1.0 m.
Determination No.99/012 (12 October 1999); the application was made by an owner of an
adjoining undeveloped site, who was concerned with an existing retaining wall on the boundary.
The applicant contended that clause F4.3.1 of the Building Code required a safety barrier.
The objective or purpose of clause F4 is to ‘safeguard people from injury caused by falling’.
Clause F4 does not have the purpose of protecting other property. The Authority’s decision was
that they did not have the jurisdiction to determine the matter because the site was undeveloped
and people were not likely to be at risk from falling.
If the risk of falling causing injury exists, Council must make a reasonable decision based on the
objectives of the Building Code. In this case, Council would be reasonable in requesting that the
owner of the undeveloped site (as part of his development) to install safety barriers
