Subject: Formal Complaint Regarding Unjust Prosecution and Resulting Financial Hardship
Dear Sir/Madam,
I am writing to formally lodge a complaint against the New Zealand Police regarding their handling of a fatal road incident that occurred in Palmerston North approximately five years ago.
In the incident, my vehicle was struck by a motorcyclist who was reportedly travelling at a speed of 130km/h. The motorcyclist died at the scene, and despite overwhelming evidence pointing to no fault on my part, I was treated as a criminal suspect. The case was reported as a criminal matter, and I was subjected to years of legal proceedings.
To defend myself, I was forced to apply for legal aid and later had to cover expert witness costs and legal representation fees out of my own pocket. Ultimately,after nearly two years, the court found me not guilty of any wrongdoing. However, I was left with approximately NZD $25,000 in legal costs—an enormous financial burden for someone who was entirely innocent.
This experience has caused me immense emotional distress and financial hardship. I believe the police made a serious error in judgement by treating me as the offender in this situation, and I question whether the investigation and prosecution were conducted with due care and objectivity.
I respectfully request the IPCA to investigate:
- Whether the police acted appropriately in treating this case as a criminal matter,
- Whether the investigation was handled in a fair and impartial manner,
- And whether there are grounds for the police or the Crown to take responsibility for the legal costs incurred by an innocent party.
I would be grateful for your acknowledgement of this complaint and advice on the next steps.
