谢谢你的多次支持,非常感谢
no worries.
i think for this course it's really important that you link back these theories and concepts to the purpose of the course: it's called law n society, so it's a study about the relationship between the law, our legal system n the society as a whole. all of these theories offer valuable insights into this relationship, n it's important to be able to illustrate your understanding of this fact
to get good marks, you need to:
(1) understand what the theories are, be able to explain them in ur own words, n illustrate w/ examples (ie the cases): e.g. idiosyncratic factors in law, as observed by CLS, found in fitzgerald: judge's discretion
(2) understand how the theories are similar/different from each other
(3) understand how the theories try to explain the relationship b/w law n society, n where they fail : e.g. naturalism justifies why murder is seen as a crime, but fails to explain why there're changes in law: e.g. prostitution has now become legalised --> because social values are not static, n this impacts on our law. (nice points to throw in: e.g. naturalism "born" in western christian society, hence the shortsightedness). does pluralism do the job then? well, nice thing to note that everyone's different, but doesn't help when we wanna accuse female genital mutilation a crime, does it: i.e. it implies that all cultural/legal values legitimate, n we know we don't want this etc. etc etc
if you can do the above: ie. show your understanding of the course as a coherent whole, throw in own little thoughts (perfectly okay if you copy mine) then there's no way how you will get less than an A-, well, for this part of the course anyways.
good luck everyone, n remember there's really no need to get more than a c+ in this course, unless u want to get into llb honours
laterz.
