After we have been bullied by the TB to pay for all the damages, 3 of us decided not to submit to humiliation anymore, hence we've decided to go to the tribunal to accuse her for she is against the law.
As you all should have known, if you are renting house, you should send your entire tenants bond to Bond Centre instead of keeping it yourself. If you don't, you could face a maximum penalty of up to $750 dollars, and worse, this is going to cause you very bad goodwill for your own sake as well as it leads to your difficulty of renting your house in the future.
However, so far as I know, our greedy landlord broke this law; hence if we go to tribunal, I believe the judge won't like her first appeal as a law-broker. Also, here's a tip for winning lawsuit, just remember, all the judges are made of blood and flesh like us, they will always pity for those who are weak and help those who are poor(maybe not in those corruption countries). Therefore I'm sure the judge will stand on our side. Because we are just poor students compared to the rich Tiger-bitch who owns several sapphire apartments with amazing sea view.
Now, let's get to the point. We won't and are not even able to employ a lawyer in the tribunal therefore we are going to deal with all the pleading only ourselves (poor 3 of us). First, the sink bed, obviously the judge should be aware that should be considered in its poor quality instead of our business. As for the room's cleanness, when TB point it out to us, we did ask her in earnest that if she could make a list for us about which part in the apartment need more cleaning but she refused it. The only thing she said is "oh, do we consider this as clean? The ground is not as light as before, the carpet is not as new as before...” And the order that TB gave us is to clean the carpet by carpet specialist. However, when we moved into the apartment, we did not even have an official contract, not even a rough one, but now, she is deducting our bond very officially, and to me it is totally non-sense. As to the bulgy floor, the TB threatens us saying that she has got a witness, and I told her, I have got a witness, too. Cases like those, without any clear evidences, only witnesses presents are no use at all.
At the same time, the most exciting thing for us is to ask for the mental loss that we've suffered for compensation. I’ve concluded all the points below.
• An amount of $55 dollar of the tribunal fee
• We’ve sent a career letter to the landlord which cost us $5.50 with the receipt
• We don’t have a car; hence the bus fare to the tribunal will become the landlord’s obligation. 3 of us with 2 stages total cost $9(all adults’ tickets)
• The day when TB checked our room and asked us to make an appointment with the cleaning company which we called it with our cell phone that costs $15.
• I’ve booked a plane ticket to China for the following week, but didn’t expect that I cannot take my booking fees back, hence the $200 booking fee…
• My mother is very ill at home and I have to go to tribunal without taking care of her, I felt extremely guilty in my heart, hence I’m asking for $100 compensation fee. (Compared to the $50 dollar sinking bed of physical damage, this mental damage is not ridiculous at all; physical damage only affect you for a fixed period of time whereas mental damage will affect you forever forever…)
• Finally will be the total interest of $1110 bond that should have belonged to us if those funds were put in the bank according to the 7% high interest in NZ’s bank. The date that we moved out is 1st of December; today is the 7th of December, already one week has passed. I’m going to the tribunal tomorrow and everyone should know Kiwi’s unique working efficiency; they will take forever to do anything. My estimate is that the tribunal probably will give me notice in about 2 or 3 weeks, so lets say we’ll probably get one or two month of 7% interest for the total bond $1110…
At last, just want to remind people that, when it comes to these matters, just as I said, never let it go like that, because person like TB only bullies weak people who do not say a word to this. Thus if you don’t want to be the weak one, stand up to them then!! |
