1. do you still have your old tenancy agreement signed with your previous landlord?
2. if so, when the apartment was handed over to the new owner, there should be a clause in their Sale and Purcahse agreement stating there's an existing tenancy and it will remain for x months with the very SAME tenancy terms. legally, your ex-landlord is responsible in making sure of this smooth tenancy transition. and they could be your best witness (otherwise they will be liable for it). and if your ex-landlord did his/her work properly, your current landlord CANNOT deny the term about water payments.
3. who did u pay ur bond to? old landlord or the new one? did your landlord lodge the bond money to the department of building and housing? if unsure, the simplest indication is that you have NEVER been asked to sign a Bond Lodgement Form by your landlord. Your landlord MUST pay the bond to the Department of Building and Housing. Failure to do so is deemed to be an unlawful act of landlord. If that's the case your landlord will stand no ground. |
