以下是原法第33条，修正案没有改这条
33 Certain transactions exempted from requirement for consent
(1) The requirement for consent does not apply to the extent that giving effect to a transaction has any of the following effects:
    (m) the acquisition by an overseas person of securities or rights or interests in securities or property if—
         (i) the securities or rights or interests are, or will be as a result of the acquisition, relationship property (as defined in section 8 of the Property (Relationships) Act 1976) of the overseas person and the overseas person’s spouse, civil union partner, or de facto partner; and
         (ii) the overseas person’s spouse, civil union partner, or de facto partner is not an overseas person:
    (n) the acquisition by an overseas person of securities or rights or interests in securities or property as a result of a division of relationship property under the Property (Relationships) Act 1976:

修正案二读版本又增加了一条关于配偶豁免的：
36AF Exemptions relating to relationship property where spouse or partner
granted consent under commitment to reside in New Zealand test
(1) This regulation applies if—
    (a) a transaction will result in an overseas person acquiring any interest in residential land, or any right or interest in securities of a person who owns or controls (directly or indirectly) an interest in residential land (relevant interest); and
    (b) consent has been, or will be, granted to the transaction on the basis that a person (A) is a key individual and the commitment to reside in New Zealand test has been, or will be, met; and
    (c) the relevant interest is, or will be as a result of the acquisition, relationship property of A and A’s spouse or partner.
(2) The acquisition by A’s spouse or partner does not require consent under section 10(1)(a) of the Act.
(3) In this regulation,—
relationship property means relationship property as defined in section 8 of the Property (Relationships) Act 1976
spouse or partner means spouse, civil union partner, or de facto partner.

Once the law is passed, the bank will not likely to deal with a partner who is non-pr to borrow. This will pose a challenge. You can check with the bank before spending money on 家庭基金.

As far as the Overseas Investment Act is concerned, the non-pr won't be able to hold title on the residential property. ( exception on approved apartment for overseas buyers for renting purposes).

--------------------> this exemption refers to overseas person who already been granted consent ( after going through the benefit to nz test and his /her partner would be exempted from further consent process).

这里说的应该是commitment to reside in New Zealand test。
结合这两条，应该就是说需要测试的海外人士只要一方通过测试，配偶就可以豁免；不需要测试的非海外人士的海外配偶不需要测试。

新西兰一直都是这样发展的，比较独立比较走自己的路线。这样有益处，但过头了就有害处。

政府的政治意图大于经济意图,等着看吧，政府能出台鼓励经济发展的政策才是真。

1) it is not the director, it is the shareholding that will define the foreign owned company.

2) if the overseas person stay here for 183 days, he will need to pay NZ tax for his global income. So, don't think it is a free lunch.

3) circumventing (bypassing) the OIO process is defined under the Act ------> the person who assists in this process will be jointly responsible and liable and OIO can hold on to your property until you pay the penalties ( civil and criminal) or sell it for you.

- there is a consequence for bending the rules eg like fake marriage, fake degree, now the new fake land ownership.?
