Hi, my husband and I both agree to divorce, but we still live at the same house but different rooms.
How could we dirvoce? We already filled in the form FP13, FP14 and G7. But don't know where should I send to.

Thanks for your information.
Is that mean at this stage, my partner and I could only wait for the two years then hand in the application to family court? Nothing else we could do like pre-apply right now?

Hi, thank you for your question.

Firstly, in order to file for divorce in New Zealand you and your husband would require a period of separation of two years before applying to the Family Court.

It would be tenable if parties choose to live in the same household but in different rooms as long as the two of you have orally agreed to separate in the form and manner described.
