大律师,我想问下,我的朋友被一家中国店解雇,这家店是中间卖掉的,新的雇主接店三个月,我的朋友在这家店已经两年多,一直拿的工签(现在是MANAGER的签证),现在的雇主接店后让我朋友做了三个月,合同签过两份,第一份在接店那天,到今天已经超过三个月,第二份还没有,请问雇主有权无任何原因罢免掉我的朋友MANAGER职位吗,我朋友的工签会不会有问题,合约有写有三个月的试用期

3个月的试用期 应该是可以的... 要看合同上面怎么写的.. 应该有一个地方上面写着 如果要辞退的话 需要多久的Notice 或者需要一定的理由.. 那个合同很重要...

您好,取决于新雇主用的是什么名字。如果是买老店的公司,为同一雇主,那么三个月的试用期不合法,因为试用期只适用于之前没有被雇用的员工。在没有理由的情况下解雇,属于非法雇用,您的朋友可以要求赔偿的。

如果是完全新的公司,新的雇主,那么三个月试用期合法。



[67AWhen employment agreement may contain provision for trial period for 90 days or less
(1)An employment agreement containing a trial provision, as defined in subsection (2), may be entered into by an employee, as defined in subsection (3), and an employer as defined in subsection (4).
(2)Trial provision means a written provision in an employment agreement that states, or is to the effect, that—
(a)for a specified period (not exceeding 90 days), starting at the beginning of the employee's employment, the employee is to serve a trial period; and
(b)during that period the employer may dismiss the employee; and
(c)if the employer does so, the employee is not entitled to bring a personal grievance or other legal proceedings in respect of the dismissal.
(3)Employee means an employee who has not been previously employed by the employer.
(4)Employer means an employer who, at the beginning of the day on which the employment agreement is entered into, employs fewer than 20 employees.
(5)To avoid doubt, a trial provision may be included in an employment agreement under—
(a)section 61(1)(a), but subject to section 61(1)(b):
(b)section 63(2)(b).]
