Section One-Law (40% of exam)

You are required to answer both Question 1 and Question 2 and your answers must be set out in ILAC format. They are worth equal marks.

Question 1
Advise Eighty Days Ltd (Eighty Days) of their legal rights under the Contractual Remedies Act 1979 against ServIT.
Question 2
Explain whether Sally has a valid claim against Cleanrite and /or Jason for her injuries and other losses.
Section Two-Management
(40% of exam)

You are required to answer both Question 1 and Question 2. They are worth equal marks.

Question 1

ServIT Ltd (ServIT) has noticed a recent increase in sales volume and value and is beginning to think that the recession must be coming to an end. The owners of ServIT, Sally and Andrew, have decided they can afford to spend some money on the business and are considering choosing one of the following five options:

• Recruit a human resource manager reporting to Andrew and Sally with responsibility for human resources across the company;
• Extend the existing nine day fortnight working scheme to cover all staff except managers;
• Appoint one of the existing staff to Sales & Marketing Manager to allow Sally to focus only on her strategic role within the business;
• Offer the possibility of a 'job share' to recruit & retain talented but scarce IT trainers;
• Employ Andrew’s 22 year old niece Anna who has expressed interest in joining the business. Anna has just graduated with a BBus majoring in Management and Information Technology.
  
  

Identify which option would be most beneficial for ServIT. Drawing on a broad range of management theories and concepts from this semester's classes discuss why you choose that option as opposed to the other options.
Question 2
Use Lewin's three stage theory to explain how ServIT should implement the choice you made in your answer to 1. Your answer should take into account possible resistance to change.

Section 3 – Social Science
(20% of exam)

During the semester we have studied:

(a)Theories of employment relations;
(b)The Employment Relations Act 2000; and
(c) Employee participation schemes.

Write an essay that uses at least two of (a), (b) or (c) to analyse and resolve problems in employment relationships between Sally and the trainers Isabella, Tim, Sonia and Arabella

Your essay should be around 2 to 3 pages in length.
