商业租金怎么办?

如果租赁合同里面没有特殊说明，那租金应该照常交吗?
跟洋人房东商量推迟，可是基本无果。

lockdown 其間是可以不交稅或只交部份，但要看你的 deed of the lease.
如果是 2012後出的 deed of the lease.
有一條是 27.5叫 no access in emergency, 因為不可進入你的店可以不交全租。
因為條例太新，沒有案例要和房東慢慢傾。但當然不是全免。
但如果你的 deed of the lease裏沒有 27.5的 no access in emergency.
就不能要房東免租了
你馬上去看看你的lease是 deed of the lease還是 agreement of lease.
如果是 agreemrnt of lease 就不是正式的租約，到有問題時會 refer 去 deed of the lease 最近版本也獲 no access in emergency 條例的保護。
但不是全免，雜費總要付

再跟您确认一下，如果只有Agreement of Lease，上面没有Clause 27.5的话，是不是Deed of Lease上的standard terms and conditions仍然生效？

根據律師說，我拿的是 agreement of lease不是 deed of lease.
Deed of lease 是正式的 最有法律效用 ，但必須由律師做。
Agreement of lease是 是屬於暫時性但有法律效用， 可以一直用直至租約完成為止。
一些大型的租務到最後 還是會再簽一張deed of lease去 confirm一些很 detail的東西。

但很多小型的很多時候也沒有做 deed of lease
就像我做 foodcourt，agreement非常簡單。

Agreement of lease 由於內容簡單，所以一定不會有 27.5
到有麻煩時發生時再去, 參考最新版本的deed of lease, 因為 2012之後的 deed of lease已經加上 access of emrgency 去保護不能進入的租客。那是因為上次基督城地震之後，發現 漏洞，要保護租才加上去的

所以拿 agreement of lease 就可以用 access of emergency 去同業主 討價還價

如果你的lease上有一條，法律上你有權可以要房東減，房東在法律上怎可不同意。
如房東要硬來，你又願意那沒話說。
看你要怎麼保障自己的權益，有很多房東一定不想減要硬收。就好像老闆不給最低工資是違法，但有些人不投訴也樂於接受。
反正我先找好所有資料去和房東先商量。
不成的話我會找律師寫信，不付全數就是。
如有必要我會去政府部門求助的和投訴的

房东都不是搞慈善的，你只能找工党求救了

我的店東未有回覆，說五月看疫情怎樣再說。

現在可以先不付，看政府有沒有安排。
先拖着，看政府有那個部門或 hot line可以做紐中間人。

房東大多數也有點怕政府， 一定要堅決表示你會投訴他， 一般和人房東都不會想收到政府的信 如果要找他協助提供資料之類房東一定 極度不願意。

这个27.5 是在damage or destruction of premises 里的。 我的理解是，如果建筑收到破环，不能进去或者有关机构禁止进入，这个条款才有效。

Homeware giant Harvey Norman is refusing to pay rent on some stores during the level 4 lockdown.

The Australian-owned company sent the letter to a number of landlords around New Zealand on March 25 telling them that it would not pay rent while its stores were closed.

Harvey Norman leases stores as well as warehouses.

The letter, provided to Stuff, tells landlords that they had 24 hours to respond otherwise Harvey Norman would consider the matter settled.

Harvey Norman head of property in New Zealand, Anthony Dainty says in the letter that All Harvey Norman stores had been closed under the lockdown requirements.

"As a result all payments of rent, operating expenses, promotion levies and other lease related payments shall immediately cease until such time that the store re-opens and becomes accessible to staff and the wider public," Dainty says.

Dainty told landlords that Harvey Norman was committed remaining in communication with them but did not indicate any room for negotiation.

"We look forward to your agreement to the above by reply confirmation email. Should we not receive a response within the next 24 hours, we will assume your acceptance of the contents of this letter."

“有关权力机构禁止进入”这条是or的条件，一旦激活，已经满足条件。
可以不付。
例如25/3-31/3这几天的房租还能有权要求退返。

基本上房东是这个意思：
Under the present circumstances we understand that you may not be able to pay your rent when you cannot access your site to sell products.  We have approached our Bank for assistance.  I hope you can approach the Government too to help you financially.  Our Bank has agreed to charge us interest only on our building loan while we are under lockdown due to the corona virus.

还有个问题，outgoings像是building的地税和保险这些，应该照常付吗？

大概給平常的一半左右，算正常減幅

27.5的 no access in emergency只是说这种情况下租客和房东可协商，协商不成像Harvey Norman就开始耍流氓不付，最终需要上法庭解决，当然法庭也只能调节或者酌情判决，总之双方应该是各让一步吧

租客没法开业，房东也有贷款要付，地税保险物业维护也没减免，现在大家都很难，据说政府也在研究出台补贴

租約上有 27.5的算好彩了，很係 2012年前簽的舊約是沒有的。
那就要付全數了，怎樣耍流氓也沒用。

終止合約的話，空出來也是房東吃虧，收你 丨個月全租或免租。by law 免租期地稅還是租客付的，房東就小收租金罷了。

第一能再租出去肯定是疫情結束後一段時間，空出來的時間地租還得自己付。
能租出去的話，新租客還是有免租期一個月左右的。如果經地產中介租出， 還得給大概一個月租金 金的中介費。
萬一日疫情後市道不好， 可能還要減租呢？
By law 房東可以把店收回來，問題是收回有什麼好處？

大家目的是求財不是求氣
