资金来源证明问题

各位大神 想问一下各位的意见

10年前开始钱就已经放银行账户里了吗？如果是这样就直接打个半年一年流水单作证明就好了。

如果需要贷款的话,和爸妈确认下这个钱究竟是借给你的还是赠予给你的。

原则上如果借给你的话,银行会把这些钱当成你现在的债务。

赠予给你的 --------> if both of you split one day, the money and property will be split half-half. Plenty of stories (cases) in Auckland on this issue, just because of "convenience need" to the Bank. So be warned.

借钱给我们买房子-------> that will be inconsistent on what you told bank (if you apply for a loan). Your lawyer will be put in a position where his certification is inconsistent from the bank's instruction. In another word, dishonest/ short of fraud.This issue will be litigated when the couple split, and one said is "gift" another said is "loan". Then the Bank will find out when the mortgage is not paid etc. Again, plenty of stories (cases) on this issue in small Auckland.


洋人律师 只答说有资金来源证明就好----------> They will still do your conveyancing settlement (to make a living on conveyancing fee). however, will report the transaction to Financial Intelligent Unit (FIU) identifying you and your parents in the "Suspicious Activity Report". The Test is an objective test - "3rd party fund, from overseas, are catchwords and will lead to the filing of report". They need to file the report otherwise they are held responsible and liable. They won't tell you under the law. It is stated in their letter of Engagement.

The Police said (recent report at DIA website), they have received more than 30 "suspicious activities reports" in the last 3 weeks and will do profiling in conjunction with DIA. They will share information with Countries (eg China) participating in the anti-money laundering task force.

DIA said to lawyers in a talk that " I hope I won't see you on the front page of the news together with me......." ( So, be warned).


In short, talk to the right people, don't let a blind leading a blind and both might end up in Holland, that won't be good.

是贷款
如果是现在的债务和与被赠予的钱 有区别吗？ 海外的钱都得要证明 是吧？

如果以父母赠予的方式购房,(不是自住房),以后卖房会不会抽重税?
