I’ve been ticketed for parking in the car park of a shop while dropping off kids at school
Have you been asked to pay $100 or more because you parked for a few minutes in a private car park while dropping off your children? Do you have to pay?
The law says that you only have to pay for the damage, harm or loss that you caused to the landowner.
You may have trespassed if you did not park there for the purpose of entering one of the shops, but what harm did that trespass cause?
In this situation the harm is that legitimate shoppers may not have been able to find a car park and this may have caused the shops to lose business.
Our advice
Offer to pay a smaller amount. Do this in writing, stating that you will not be paying the full amount and explaining why not. Keep a copy of your letter for your own records.
If you agree that you did trespass, you could offer to pay what you think is an amount that better represents the damage you caused. If the landowner or their parking enforcement company continue to demand that you pay the full fine, keep informing them that you dispute liability. If the fine is referred to a debt collector, tell the collector that the amount is in dispute and send them copies of the earlier correspondence. Also tell them that if any default is listed on your credit rating, you will complain to the Privacy Commissioner.
You can take the matter to the Disputes Tribunal at any time and claim non-liability, but you will need to pay a filing fee. |
