Dear Y~~,
Firstly we would like to apologise for the delay in responding to your inquiry about your practical driving test and thank you for your patience.
In order to answer your inquiry we have reviewed the test paper and gained a report from R***, your Testing Officer on the day.
In your inquiry you have noted that you thought you were unsuccessful because you didn’t give way correctly.
Ross’s report confirms that, as you approached a T intersection you stopped to give way and check for traffic. East Coast Road has a speed limit of 80 km/h, so vehicles are travelling at high speed. The notes on the test paper confirm, that there was a vehicle approaching from the left, which you say ‘I couldn’t see any car’. By the time you moved off from a stationary position the vehicle approaching from the left was too close and needed to take evasive action by braking to avoid a collision. This is marked as an Immediate Failure Error. For more information please see below;
At a T-intersection or driveway, traffic on Awanohi Road (bottom of the T) must give way to all traffic on East Coast Road (top of the T).
Picture of a T intersection
Approaching an intersection
• slow down and look in all directions: ahead, behind and to both sides
• be ready to stop if you have to.
An immediate failure error is recorded if; another road user is forced to take evasive action, due to an applicant’s poor gap selection. The Testing Officer must immediately return via the most direct and safest route to the office and the test is stopped.
Our findings show that Ross was correct to issue an ‘Immediate Failure Error’ under the heading of ‘Fail to Give Way’ as required in the NZTA Testing Officers Manual.
We would like to apologize for the delay in getting back to you and wish you all the best with your next test appointment
Kind regards
我今天给vtnz的回信:
Dear Colin,
Thanks for there is a reply after all.
I would like to tell you I have already passed the restricted practical driving license test yesterday.
With all due respect, still want to clarify the one I failed which the one I reported to you. I do aware what the give way rule is especially on T- section. (I stydy very carefully with the rules, vtnz guide, restricted test video on youtube and also practice as possible as much) Again, the fact is "I couldn't see any cars coming" from both directions includes the left from my sight (driver's sight), and if Mr. R*** can recall the situation fairly, I didn't cause the coming car from the left was forced to take an evation action, it was only shown when I almost position my car in the lane. And I could see from the rear mirror we were in a very safe distance.
I hope Mr. R*** and the testing system he represented is professional and fair. I do apprecate the strict tests for a person who want to become a driver, it is our mutual responsibility to the society as a whole. But the fact is the fact, you cannot fail a person with an error he/she didn't commit. If there are other issues may cause you feel I was not a safe driver at that time, you may explaine me that way, but this what Mr. Ross said is not the turth.
I feel so disappointed of what your report and finding are.
Y~~
