6. Holidays and leave
6.1 The holiday andleave entitlements in this agreement incorporate and are not in addition to theentitlements provided in the Holidays Act 2003 (as amended)('the Act').
6.2 The Employee isentitled to 4 weeks paid annual holidays upon completion of 12 monthscontinuous employment with the Employer.
6.3 If thisEmployment Agreement is terminated before the Employee has completed 12 monthscontinuous employment then the Employee shall be paid 8% of their grossearnings at the date of termination as holiday pay, less any annual holidaystaken in advance.
6.4 Where theEmployee works on any part of a public holiday, the Employee will be paid thegreater of: (a) theEmployee's relevant daily pay rate for that day, less any penal rate applicablefor that particular day, at time and a half for the hours actually worked; or (b) theEmployee's relevant daily pay rate (including any penal rate) for the hoursworked that day.
6.5 If the Employeeworks on a public holiday; and that day would otherwise be a working day forthat Employee, then the Employee is entitled to be paid at 'time and half' orin accordance with 6.4 above for any hours worked on that public holiday, plusan alternative holiday at the Employee's relevant daily pay. 6.6 If the Employeedoes not work on a public holiday, and that day would otherwise be a workingday for that Employee, then the Employee is entitled to payment for that day atthe Employee's relevant daily pay.
6.7 If the Employeedoes not work on a public holiday, and that day would not otherwise be aworking day for that Employee, then the Employee is not entitled to any paymentfor that day and is not entitled to an alternative holiday.
6.8 Employees agreeto work on public holidays when requested to do so by the Employer, if thatpublic holiday is otherwise a working day for the Employee.
6.9 Following thecompletion of six months continuous employment the Employee is entitled to fivedays paid sick leave per annum.
6.10 Sick leave mayonly be taken when: (a) the Employeeis sick or injured; or (b) theEmployee's spouse is sick or injured; or (c) a person whodepends on the Employee for care is sick or injured.
6.11 Unused sickleave can be accumulated to a total of 20 days. Unused sick leave, including accumulated sick leave, will not be paid tothe Employee by the Employer if employment ends.
6.12 The Employer mayrequire the Employee to produce proof of sickness or injury for sick leave: (a) if thesickness or injury that gave rise to the leave is for a period of 3 or moreconsecutive calendar days, whether or not the days would otherwise be workingdays for the Employee; or (b) if theEmployer has reasonable grounds to suspect that the sick leave being taken bythe Employee is not genuine because none of the grounds in 6.10 exist; and the Employer informs the Employeeas early as possible that proof is required; and the Employer agrees to meetthe Employee's expenses in obtaining the proof. The Employer maywithhold payment for the leave until proof of sickness or injury is produced bythe Employee.
6.13 The Employeebecomes entitled to bereavement leave after 6 months continuous employment inaccordance with the Holidays Act 2003;
(a) The Employeemay take three (3) days bereavement leave on the death of the Employee'sspouse, parent, child, brother or sister, grandparent, grandchild or spouse'sparent.
(b) The Employeemay take one (1) day bereavement leave on the death of any other person, if theEmployer accepts that the Employee has suffered a bereavement as a result ofthe death.
