房产证上的Encumbrance

请问一下房产证上的Encumbrance to Auckland Council对于房子有什么影响？
Covenants of Encumbrancer是关于stormwater soakage system, annual rent charge是20刀。
这样的房子能买吗？需要注意什么？

Mostly happened in new development such as apartments and townhouses.

They are often to do with the RMA. examples, the council has the right to put a stormwater pipe through the property and so on... among other things.

Encumbrance range priority over mortgage, not likely council will remove it, it is part of the condition they impose on consent notice.

所以我问了一下这个encumbrance签的时间   有些年代很久远的encumbrance的内容比较奇葩  一年20刀的council费OK啊 不知道有没有议价条款

Encumbrance 是挺舊 有著類似easement和covenant 之間 (而現在則是covenant in gross) 的法律工具 像mortage 一樣通常約束一方有相關債務需要支付  也能用來規範著和這塊地附近沒有業權的第三方在這塊地上的某種利益 （例如這塊地有council 管道流過 council 並不是這塊地四周鄰居的業主) 它不是RMA (Resource Management Act)  而是 Land Transfer Act 1952 和 Property Law Act 2007 的東西  和 consent notice （consent notice 才是RMA 下面的產物  這個的話 Council 是可以enforce的） 也沒有什麼關係   兩者性質其實不同  -  不過樓主這些問題最好找律師問
