自住了四年现在做过户去掉一个人名出租，影响明线吗？

我和母亲名下有一套房产，现在想去掉我的名字变成我母亲一人持有，然后出租。律师说很简单过个户，我问的会计说有可能会碰到明线。我买的时候是自住房，住了四年，现在过户出租赚租金，万一我妈妈以后想卖房，需要交明线的税吗？现在重点就是过户这个操作影响计算购房时间吗？谢谢

过户时的 market value就是买价。

律师应该是当买卖来处理（最简单）。
这样的话之前这拥有四年不用算明线；后面如果五年内买卖就是明线。

真正的自住房只要不要在一定时间内交易频率过高是不受明线测试限制的，相反，哪怕是你05年买了一套房，现在想买，ird认定你当时买房的intention是为了resell for profit， 那你也要交税，你这种情况，名字过户到你妈妈一个人名下虽然也算是买卖，但是这之后只要不要立刻出手，往外出租并且按时做rental income，没什么问题的

Conveyancer who change name for you normally do not discuss Tax issues, if you have any concern, they normally ask you to talk to an accountant. They do what is required for present transaction, they won't bother what you will do in future. That reflected in their pricing.

That is also in their letter of engagement.
Some people have high expectation on Conveyancers to do east, west, north, south and end up disappointed. Put it this way, if it is not the scope of work as agreed, they won't do it.

Just like engaging a plumber, they came in to do a specific job, not discuss and do your whole house plumbing issues for you.

I was SHOCKED when I first time realised a plumber will break open the wall to fix a pipe but WILL NOT fix the wall for me. He told me he is not able to patch the wall because he is a plumber...haha

It is a cultural shock rather than anything.

Some people talk bad about service providers, the thing is the way things are done in this society can be different from another society they (immigrants) came from.

People don't provide free advice and service (and take on the responsibilities), it comes with a price hence there are chargeable units on the scope of works agreed.

Also, people don't simply go out for coffee or make phone calls (in and out), if their time is chargeable units during working hours.
