关于新生baby办理PR的问题

打算在NZ生，妈妈是PR,爸爸不是，不想给孩子留NZ国籍，但是只想留PR,能不能办理啊？ 还是说NZ出生就一定是NZ公民？

孩子父母如果不是公民的话，从2006年开始，在新西兰出生的小孩并不会自动成为新西兰公民而是享有父或母拥有的居留权。

你可以点击：http://www.dol.govt.nz/immigration/knowledgebase/item/1084，下载Request for statement of immigration status of child born in New Zealand on or after 1 January 2006 (form NZIS 1137)，再连同小孩的出生证明，寄到移民局，给你一个身份证明。根据移民局这服务是免费的。

至于小孩在中国的公民身份就需要你们自己在中国办理了。

還是這個是出生前都可以選擇的? 不是很清楚呢~~
或者你可以問一下你的MW她應該比較了解~

9楼和6楼说的内容感觉是完全相反的哦。 其实，我就是想在nz生，体验一下美好又人性化的生产过程，但是又不想以后回国太麻烦，所以想给宝宝只保留pr不留citizen。 所以这样也ok吗？

9楼和6楼说的是一样意思
意思是2006年以前只要小孩在nz出生，不管父母是什么身份都可以享有citizen。不过政府改了政策，所以9楼说的也正确。只要一方父母有pr或者citizen，小孩就是citizen。

应该不是的，除非你回国生~~~在这边生的话，父母2个中一个是PR或者公民，孩子就直接是公民了~~~

现在情况有变化了，你看看那些 有关 旅行证的帖子

就是说，新西兰给你小孩护照，但中国好像当这个护照不存在一样，给你发旅行证，意思就是这小孩还是中国护照

我也有点晕，但很多妈妈都遇到了，前提是爸妈没有nz护照，符合你的条件

我不太清楚了旅行證是什麼樣的一個存在，假定父母隨便一方是PR，孩子就是Citizen by birth，這樣的話根據中國國籍法就變得很麻煩，因為要界定寶寶是不是中國公民海外出生的“中國籍”子女

i） 父或母為中國公民，本人（寶寶）出生在外國，出生時沒有獲得外國國籍的，孩子具有中國籍
ii）父或母為中國公民並定居在外國，本人（寶寶）出生在外國，並於出生時獲得外國國籍的，（寶寶）不具有中國國籍，一般情況而言，擁有外國居留權者，將被視作定居在外國

中國公民只能為海外出生的“中國籍”子女申請中國護照，非中國籍子女就沒轍

雖然中國不承認雙重國籍，但它可以把你其他國籍的護照當作旅遊證件，就如香港的BNO一樣，不過BNO是真的沒有國籍，而新西蘭護照有。所以我覺得旅行證就是一個灰色地帶，一個默許，但是日後孩子長大後還是要面對選擇國籍的問題，遲早而已

像你這樣如果你真的想要新西蘭PR的話，迂迴一點，在澳大利亞甚至斐濟湯加生，那寶寶就不是NZ Citizen，可以申請中國護照，然後你給寶寶申請新西蘭PR，再回到新西蘭，一般嬰兒因為要跟著母親應該很快就可以下來，也不知道這樣行不行？

這樣至少可以規避中國國籍法關於寶寶國籍的羈絆，不過中國護照就算是NZPR去澳洲也有很多限制，我不大熟澳洲規矩，坐等大神

不是，如果你不是公民的话，小孩子在2005年后出生的话不会自动变成公民。如果你只是PR，小孩就只有PR。如果你有工签，小孩就只有”工签“的居留权。如果你拿的旅游签证的话，小孩也只有旅游签证。

如果父母任何一人是有公民的话，小孩才是公民。

在新西兰出生的小孩不会自动享有公民或居住权。

第二项就是说如果父母一方有永久居民，小孩就是citizen by birth。所以现在在nz出生的小孩，只要父母一方是pr或者citizen小孩就是citizen by birth。就算是pr也是citizen。如果去开dept of internal affairs那个link会说的更清楚，nz pr或者澳洲citizen、pr都算是。

我们夫妇是pr，小孩去年出生的出生证就写着citizen by birth，而且nz护照也申请到了。

这样貌似不ok。。。

但是由于你说孩子的父亲不是PR的话。。。

那么中国大使馆是不承认你孩子的新西兰国籍的。。。

他们会认为你孩子仍然是中国国籍 所以回中国 中国大使馆是会颁发旅行证而不是签证。。。

但是新西兰是承认你孩子是新西兰国籍并且给你发黑色本本的护照。。。

实践证明。。。

只要单方或者双方父母有PR 无论是否已经坐了两年移民监。。。

生下来的小朋友都是黑皮护照（新西兰国籍）。。。

这是无数实践证明。。。

只是现在中国大使馆不承认单方父母是PR 或者PR没有拿够两年（意思就是没有坐够两年移民监）的父母生下来的小朋友是新西兰国籍 只承认他们是中国国籍。。。

这只是涉及中国大使馆而已。。。

对于新西兰政府及其大使馆都是承认小朋友是新西兰国籍也就是俗称的citizen。。。
