我在一家奥克兰大型IT公司工作了4年多，刚刚开始入职的时候公司有给我买kiwisaver, 也正常交了3个月，从第四个月开始就没有给我交kiwisaver, 我最近才发现的。 公司人事部说我拿的是工作签证不是PR所以停了。我觉得有点不妥。我想问问懂的律师或者朋友。我想追回这几年公司漏交的kiwisaver。

所以也不存在漏缴

Under the Act, if an employee is enrolled in KiwiSaver, the employer is required to continue making compulsory employer contributions at the prescribed rate (currently 3% of gross salary/wages) unless:

The employee takes an approved savings holiday, or
The employee ceases employment with that employer

Since you state you remained employed in your permanent role, and did not take a savings holiday, your employer would have been legally obligated to continue making the required 3% contributions to your KiwiSaver account.

Your employee can join KiwiSaver if they’re living (or normally living) in New Zealand and they’re either:
a New Zealand citizen or entitled to be in New Zealand indefinitely
an Australian citizen
a New Zealand or Australian residence permit holder.

只有居民和citizen才有kiwi saver，工签本来就没有
