海外收入IR3问题

因为过去几年都在中国工作，走的时候这几年新西兰这边也没有任何财产和收入。最近回的新西兰，IRD要求我补填IR3表申报这几年的海外收入，可能由于当时离开新西兰的时候有学生贷款没有还清，但这次我回新西兰后马上都还清了所有贷款。另外是不是我在中国的时间每年超过325天就是非纳税居民（其实这几年都不在新西兰）就不需要填IR3以及申报海外收入呀？
有人能回答吗？

除了看不在新西兰居住的天数， 还要看你在新西兰有没有permanent place of abode, 还有看你和新西兰有没有enduring relationship， 才能决定你在中国呆的这几年还算不算新西兰的税法公民， 是的话就要交个人所得税， nz taxes tax residents' worldwide income.

谢谢你的解答，我离开的几年没有任何房产和居所在新西兰，enduring relationship 是怎么理解啊，没有任何家人亲戚在新西兰算可以吗？当时离开的时候只有学生贷款，其他就没有了。

enduring relationship 包括在你离开新西兰的时候有没有intention to come back to NZ in the future， 有这个intention的话， 你会被纳入nz tax resident这一类。你要用一些fact去和IRD证明你离开时的intention是什么。

还包括family/social ties, economic ties, (bank accounts, investments, membership accounts etc), where was your personal belongings/property kept at,  any benefits received from NZ government etc.

最主要的两点是看你的intention和可以供你居住的居所。这些family, social, economic ties可以帮助IRD去决定你离开时的intention应该是怎样的。

没有这么复杂吧， 现在最主要的应该是permanent place of abode。

像楼主这样， 除了学生贷款， 在这儿什么都没有。显然这几年就是非税务居民了。
