Chinese driver who killed motorcyclist wants jail term canned

Jieling Xiao, pleaded guilty to causing death of motorcyclist Rhys Middleton when she lost control of car and hit him.

A Chinese woman jailed for killing a motorcyclist in a crash near Eskdale is appealing her sentence.

Jieling Xiao, 27, was sentenced to 17 months' imprisonment when she appeared in the Napier District Court in June.

She was disqualified from driving for three years and ordered to pay $10,000 in emotional harm reparation to the bereaved family of Tauranga man Rhys Middleton.

Mr Middleton was riding home with his dad, Michael, brother Ryan and two others when he and a car being driven by Xiao, 27, collided on February 7.

Xiao had been heading the same way and other motorists told police her driving had been erratic before the crash. She then veered off the road to the left, before over-correcting sharply and collected Mr Middleton as he was attempting to overtake her. Mr Middleton was 23 when he died.


Ryan tried to save his younger brother while Michael was further ahead and did not know what had happened until he stopped in Taupo.

Naturally the family were upset Xiao was appealing the sentence.

Michael Middleton told Hawke's Bay Today that it felt like Xiao was reneging on her remorse she expressed during the sentencing.

"She said she would take any punishment she got but now she's appealed it. She's appealed her remorse."

A mother's uncontrollable wailing echoed through Pukekohe District Court for the loss of her daughter this morning.

Ten months earlier, Te-Tauvira Tearii crashed head on into a car driven by 23-year-old Huan Na. Na was killed, as was her friend Zhuangya Xu. Zhentai Qi was severely injured but survived.

Twenty members of the defendant's family sat in silence as Judge Gregory Hikaka passed sentence, as did a dozen relations of the victims.

But moments later, Ms Na's mother Meng Gen could not contain her grief and broke down as others tried to console her.

An American man who admitted causing a fatal crash on a Coromandel Peninsula road has been ordered to pay $5500 for emotional harm, and has been disqualified from driving for 18 months.

Cody Dickey, 23, of Newark, California, appeared at the Hamilton District Court today for sentencing having earlier pleaded guilty to a charge of careless driving causing the death of Robyn Eileen Derrick, and another charge of careless driving causing injury to her husband, Phillip, in an accident on May 30.

An American tourist who killed a mum-to-be and another woman in a head-on crash has avoided jail time.


Thomas James Springer was disqualified from driving for 18 months and offered to pay reparation of $24,200 to the victims' families at his sentencing in the Kaikohe District Court today.

The 66-year-old caused the head-on smash while driving on the wrong side of the road on State Highway 10 near Kerikeri on April 30.

Kylee Anne Rakich was killed in the crash in April.
