What is the difference between a tenant, a flatmate and a boarder?
Last checked: 21 January 2021
Whether you are considered a tenant, a flatmate or a boarder under the Residential Tenancies Act (RTA), determines whether you have tenancy rights under RTA. Tenants have rights under the Residential Tenancies Act 1986.
If you:
1,rent a property from a landlord, and the landlord does not live on the same property, then you are a tenant. There should be a written tenancy agreement signed by both you and your landlord.
rent a room in a boarding house that is covered by the RTA, then you are a tenant and you have rights and obligations according to the Act. Read more about boarding house tenancies.
2,share a house (that is not a boarding house) or apartment with others, contributing to the rent, utilities and chores etc, then you and the people you share with are flatmates. If your name is on the tenancy agreement then you are also a tenant.
3,pay rent to share a house or apartment with the landlord or a member of their family, then you and your landlord are considered flatmates. This means you do not have rights and obligations under the RTA.
rent a room in a boarding house that is not covered by the Residential Tenancies Act 1986 then you are a boarder and you do not have rights or obligations under the RTA.
