Fence被风吹倒了要重建另外一边是reserve 问了council 下面是他们的回复

Because the property borders an esplanade reserve and therefore not covered by the Fencing Act, Council is unable to contribute to the maintenance or replacement of the boundary fence. The responsibility rests on the property owner.

有大神懂吗？不是一边出一半钱吗？

因为reserve是不需要FENCE的，随便谁都可以进。只有私人领地出于私密需求，可以建FENCE。你要没需求的话，也可以不建。一般在新西兰的路边，有FENCE，代表私人领地，不可以随便进。没有FENCE的一般是国家公园，或者reserve，你拿着枪进去都行。

公家那边本身没必要有围栏。装了是保护你的隐私不是保护市政府的隐私

Fencing Act,是用来管老百姓的。你想用这个法管council？
钱很多的话找律师咨询，钱少的话就认栽吧。
如果你砍了council的树，这时候council就起作用了。

对，就一，两块fence倒的话，可以试一下保险公司，看能不能cover.

因为他的邻居交界的地方是Reserve , 而Reserve 是属于Council的，约等于他邻居是council .

问了AMI保险公司说只能赔一半的钱另外一半让我去问邻居出所以我才去问了council

是啊 Fencing Act 1978 第三條就說下面的都括免反正就是只管百姓不管官啦只能自己付錢修了 -

Application of Act
(1) Nothing in this Act shall apply in respect of—
(a) roads:
(b) land forming part of a national park under the National Parks Act 1980:
(ba) land that is Te Urewera land, as defined by section 7 of the Te Urewera Act 2014:
(c) land held for railway purposes other than for the accommodation of employees by the Crown, New Zealand Railways Corporation, or a railway operator that is a Crown transferee company (as those terms are defined in section 2 of the New Zealand Railways Corporation Restructuring Act 1990):
(ca) land held or occupied for the operation of a railway by a railway operator, not being a Crown transferee company (as those terms are defined in section 2 of the New Zealand Railways Corporation Restructuring Act 1990), other than land used principally for car parking, the storage of freight, materials, and ancillary equipment, or administration or residential purposes:
(d) land that is a marginal strip within the meaning of the Conservation Act 1987:
(e) land that is an esplanade reserve within the meaning of the Resource Management Act 1991 or an esplanade strip within the meaning of that Act.

(2) Subject to subsection (1), this Act binds the Crown.

楼主，以前有个朋友也是和你一样。council不会帮你付另外一半的，人家council连解释都懒得和你解释。幸亏屎盖的人乐于助人。

如果council不负责，那这个fence就是你自己负责，那你的保险公司就应该付全额，而不是一半

FENCE设计时候，要考虑WIND ZONE,现在气候变化，你就默认是HIGH WIND ZONE吧。

- DRILL holes 900MM under ground
- Holes dia.meter three times than your fence post size (125mm x3 = 375 mm dia.)
- 125x75mm H4.0 2.7m Fence posts
- MPa 45 concrete premix
- 100x75mm fence rails
- standard palings
- Option: Cross Bracing on fence panel

span: max 2.0m, height 1.8m.

我们邻居是一对老kiwi夫妻，他们家就紧靠reserve，然后他们特意不建fence只种树墙，说这样一眼望去一片绿感觉reserve也是自己家的。
