最近房市好，想把自己的投资房卖了，但是目前有房客住在里面，想问下如果想让房客搬走需要提前多少天和房客说，还有就是如果带着房客一起卖的话，对于open home和settlement会有什么影响吗？谢谢

最好别带着卖，赶走房客好好清理一下做个staging再上市为妙，当然无所谓那点差价就带着房客卖

没有记错的话现在好像是90天，你最好和你的property manager confirm一下。

现在买投资方都喜欢带房客，现在没有新移民留学进来，租房的人大部分都去买房了。

我刚经历了这个问题。从买房的角度看，带着房客，就属于投资房。假如我是按自住办的预批，如果不想买投资房，涉及到贷款，或者明线测试，就需要注明，交割日期之前，房客会走人。如果做不到，也许银行贷款会有问题。重新申请贷款什么的。
这样卖也许会流失一部分潜在买家。

2月11号刚公布的租赁法，卖房要提前90天通知房客。如果有房客在，Open home 要和房客协调时间。如果是拍卖的房子，交割期通常是1个月，这个得和卖房中介说好，让她/他去告知要拍卖的人关于交割期。

如果是fixed term的话目前的规定下需要提前在term到期前21天通知。如果是periodic term的话需要90天。
如果租客愿意配合，带租客卖也是可行的，我们很多房都是带着租客拍卖掉的，前提是需要双方沟通好。

请问这个90天是指从通知租客到房子上市的时间，还是从通知到交割的时间？

You need to inform tenant 90 days (for selling house), tenant might give you 28 days notice to quit once they found a house, so is difficult to say when they will move out, the time frame is 90-28 days.

IF you want your property to expose to maximum exposure and marketing, best to market without tenant and the agent can bring buyers any time to see the house and do building inspections, etc.

For fixed term, no longer 21 days, I think is more than that like you need to inform them 90 days in advance if you are not going to renew the fixed term (need to check) with valid reasons.
