Changes to fixed-term tenancies will come into effect from 11 February 2021 as per the recently passed Residential Tenancies Amendment Act 2020. Below is an example to demonstrate how terminating existing fixed-term tenancies that will continue past this date will occur:
Example:
Fixed-term tenancy signed for 1 May 2020 – 1 May 2021, Residential Tenancies Amendment Act 2020 law changes around security of rental tenure and fixed-term tenancies comes into effect 11 February 2021.
For landlord:
Scenario 1 – Landlord can give tenant a 90 days notice without reason (under the current regulations) to confirm the expiry of the fixed-term tenancy on 1 May 2021.
Scenario 2 – If no notice is given to tenant, or no notice received from the tenant, then the fixed-term tenancy (under the current regulations) becomes a periodic tenancy (under the new regulations) after the expiry date of 1 May 2021. New regulations for periodic tenancies apply.
Scenario 3 – Landlord can offer to renew the tenancy from after the expiry of the current fixed-term tenancy on 1 May 2021. Regardless of whether the renewal is for a new fixed-term or periodic tenancy, new regulations apply. To end this new fixed-term tenancy, landlord must give notice using the reasons listed in the RTA for periodic tenancies.
For tenant:
Scenario 4 – Tenant can give 21 days notice (under the current regulations) to confirm the expiry of the fixed-term tenancy on 1 May 2021. This is if the landlord haven’t already given the 90 days notice to the tenant to confirm expiry of fixed-term tenancy.
Scenario 5 – If no notice is given to tenant, or no notice received from the tenant, then the fixed-term tenancy (under the current regulations) becomes a periodic tenancy (under the new regulations) after the expiry date of 1 May 2021. New regulations for periodic tenancies apply.
Scenario 6 – If the landlord offers to renew the tenancy from the expiry of the current fixed-term tenancy on 1 May 2021, as a new fixed-term tenancy, the tenant can give 28 days notice to confirm the expiry of this new fixed-term tenancy.
The main points of differences from this example (fixed-term expiring on 1 May 2021) to any new fixed-term tenancies signed from the commencement date (i.e. signed after 11 February 2021) are the two in bold above. Landlord can still end the fixed-term tenancy on the expiry date in this example with a 90 days notice no reason (current law), tenant can end the fixed-term tenancy on the expiry date in this example with a 21 days notice (current law). These have both changed under the new regulations.
