tenancy in common,this is a form of co-ownership where each party holds a distinct, identified share of a parcel of land.


They agreed to register the property as a tenancyin common, with equal shares, allowing each to bequeath theirhalf of

the property to their own children.


interest 如下:

问题:

1.Peter and Sarah do not own half the property each?对吗?

2. which part of the property they own?

应该是夫妻吧?(peter 和 Sarah), 房产他们两个共有的。他们两个和邻居share 各为1/2。所以他们名下就是1/4。

如果这个房产有4个人的title,那么就是每人share 1/8.我是这么理解的。

实际情况他们两个要卖房,必须卖掉1/2不能离婚了卖掉1/4。老婆搬走,老公继续住。

买房总要雇律师的,实际情况找个律师问问比较靠谱。

问律师就可以给你专业解释了。

你也没说地址,随便瞎扯一个,1/2 queen st。peter和sarah对这栋房产各占50%,而这栋房产本身对于2 queen st的地占1/2(不是专业的,就不太清楚怎么用词,1/2什么权),地和邻居有没有什么具体利益、使用等等条款,要看具体title信息。你买或者问1/2 queen st,给你的title就只是这栋房子的产权信息。买卖,屋主就只需要peter sarah签字。买了要改造,需要邻居签字了,才需要知道2/2 queen st的屋主信息。

老鼠说了个1/4,我就多少明白些了!
他们和邻居share ,占了其中的 1/2 cross lease.
然后他们两口子再 1/2 share 他们自己的那部分share
所以答案是:peter and sarah own 1/4 of property each,这下对了吧

下面是Auckland Council 網站對cross lease 地的描述:

What is a cross-lease property
Cross-lease (flats or household units) ownership involves a part but undivided share in the freehold title, along with a lease over a particular dwelling.

For example - if you buy a flat in a four-flat development that is on a cross-lease, you will become the registered owner of:

- an undivided one-fourth share in the land and buildings (as "tenant-in-common in equal shares") with the owners of the other three flats, and

- a long-term lease, from all four of the tenants-in-common (including you), for your particular flat.




除了屋主那個房子(還是互相租讓形式)和convenant上列明的 exclusive area  其他地都是大家以不分開(undivided share) 的方式共同擁有的  那何來什麼 “distinct, identified share of a parcel of land”  呢?

谢谢回复,我截错了,那段是对于tenancy in common 的描述。

这张title的情况是一对夫妻peter和sarah以tenants in common with equal share的ownership买了这个cross lease title 的房子,然后问题是:

1.Peter and Sarah do not own half the property each?对吗?

2. which part of the property they own?
