标题: Open工签到期续Essential Skills工签，是一年还是三年？ [打印本页]

请问大家，在等SMC审核，Open工签快到期了，需要续Essencial Skills工签，不用打广告，是批一年还是三年呢？移民局官网上没找到相关信息

If you are waiting for SMC, you will get it for one year till you get your SMC. we do not have to go through the labour market test.

I applied in the same manner this week. Even I was worried but when i read the immigration law, i found out we get it for 1 year.

You can refer to the immigration website, look at the law paragraph WK3.20.10 section A and section B.

WK3.20.10 Determining an Essential Skills work visa application where an applicant is awaiting a Skilled Migrant Category decision
Despite WK3.1 (a)(ii), an applicant may be granted an Essential Skills work visa, valid for 1 year without an immigration officer being satisfied that there are no New Zealand citizens or residence class visa holders available to do the work offered if:
they currently hold a temporary work visa; and
they have applied for an Essential Skills work visa to continue working in the role they currently hold; and
they meet all other requirements of Essential Skills work visa instructions; and
they have been issued an Invitation to Apply under the Skilled Migrant Category and retain the ability to apply (see SM3.1), or have made an application for residence under the Skilled Migrant Category and that application has not yet been completed; and
their Expression of Interest was selected in part on the basis of points claimed for skilled employment in the role they currently hold.
One further Essential Skills work visa, valid for six months, may be granted in exceptional circumstances to an applicant who continues to meet the requirements of (a) above.

Yes that is what i am hoping to. Due to lockdown many the processing will be faster.

But once you apply, you will get One Year Essential Skill Visa.

we have to apply every year till we get our SMC result. So not worry about it.

请问，你们批下来后，这个一年签证下来开始日期是目前的open work visa 到期后，还是从批下来的那一天就开始算。open work visa我还有半年到期。考虑什么时候申请。半年了，co还没分

从批下来的那一天算，不用太早申请

请问下，如果是SMC审核阶段，只给了一年的签证，那这一年是不是免费医疗啥的都没了？因为之前open是3年，两年以上工签才能有免费医疗吧之类的吧？这是个假设问题，只是好奇？不过也确实关心，怕万一有个病啥的。谢啦

A person who holds a work visa that either:

entitles them to remain in New Zealand for two years or more (work visas start on the person’s first day in New Zealand) OR
entitles them to remain in New Zealand for a period of time which, together with the time that person has already been lawfully in New Zealand immediately prior to obtaining the visa, equals or exceeds two years

is eligible for publicly funded health and disability services.
按照第二条，免费医疗应该是不变的

they should also get for the same duration as you.
As far as i know, partnership visa will always follow you main application timeline.

Hope it helps. My strong feelling is if the border is closed for another 6-8 months, they will have time to provess the SMC faster.

Based on the INZ latest statement, my essential skill visa will be auto-extended for 6 months, however this rule does not applied to partnership-visa...

However, if I want extend my partner's visa, which means I need to re-apply for essential skill visa, and tag along her partnership visa application again. Please correct me if i'm wrong for the above assumption.

However my EOI application was submitted before that, and assuming now I meet the salary at $51/hr or $106080/annual. Am i eligible to receive ITA from INZ?

Based on my understanding, your assumption is totally correct. You have to re-apply essential workvisa in order to tag your partner's visa.

现在都暂停了，暂停前有收到ITA邀请信的就可以，没收到信的就要等之后恢复，高薪与否没有影响

God damn... u have a good salary, why you worry about that. They will process your application faster than others for sure.

EOI suspended means they will not take new EOI, you already submitted so now you can prepare you documents and submit it

Good Luck.

Thanks mate, but my situation is I yet to receive ITA before EOI suspended.
Assuming I update my EOI information with $51/hr , it does not help to "cut-queue" and issue ITA to me also, am I right?

Hi Mate, thanks for your information. Basically my documents are ready, just waiting for company's decision on my promotion & increment. Then I only can proceed for all the necessary application.
