因为公寓漏水需要大量的钱去维修，拒绝付款被mortgagee sale，现在想想有点后悔，欠的钱也不是非常多，但是公寓已经在trade me上面被强制的mortgagee sale了，我想问一下我还有没有逆转的可能，应该如何去操作，谢谢了

你现在要找的是律师，不要在这里浪费宝贵的时间了。
律师的话要找口碑好的，处理过复杂案件的。个人建议可以和卢高那边的陈律师谈谈，看看他们有什么意见。

卖就卖了吧，不见得损失很大。你交了钱，肯定现在还没施工吧，还不知道施工开始以后会不会又要补，这种事情都难说的，漏水房打开以后才知道要花多少钱，等打开以后不由的你不加钱了。我见过无德的给人换外墙，上去先把屋顶拆了。然后房子就晾在那里。。。

your legal costs for mortgagee sale (payable to mortgagor's lawyer for this legal action) will be around $20k even if you stop now.

if you delay another week, will be another 10k added to valuation, auction fees etc etc.

Even if you find the best lawyer in town, those costs plus penalty interest will still need to be pay. ( ref: a famous lawyer who fight mortgagee sale at waimuku and now XXXX )
IF your loan is unable to be met by the mortgagee sale ( that is shortfall), they will go against you on the balance.

Your personal credit will be affected, it will be difficult for you to get a loan in the future. If you are going to apply for PR and you are bankrupt, it might also be affected.

possible 2 actions.

1) Mortgagee sale first

2) balance ( if mortgagee sale amount can't pay back the bank - loan, penalty interest, legal costs etc)

The balance amount can go under bankruptcy action.That is why 80% loan is risky to bank, especially for apartments.

Clean Slate Act - ie 7 years apply to criminal records kept by ministry of justice.

This is civil debts, people can search the credit records easily even after 7 years. Who doesn't have past and clean forever?

yes, it can still be searched by Credit rating agencies (and the information is widely shared)

i have seen one over 10 years, it is still recorded there when i did a search on a tenancy application.

那为什么很多人破产后，7年后还可以贷款，买房或做生意？

bankruptcy is not a death sentence.

If a bank wants to lend to you, why not. Many people can show after bankruptcy they are even stronger with good partners backup, good business plan etc. So, banks won't rule out this kind of people.

There are a lot of factors involved. After discharge from bankruptcy, the person can be company director again etc the person might trade under a company's name with good financial back up from business partners.

The world is not just black and white. There are in between

正常理解是，你还清债务后，5年后信誉才会恢复。不是说啥都不做等几年又好了。

据我所知mortgage sale应该可以撤销，只要跟各方面好好沟通，把欠债还清，我看见一些房子也是快到强拍的前几天突然就撤销了，还是咨询你的律师吧
