法律上是这样的。

这样的房子，我最近看到2个了，8月卖出去的，买家没有交割，房主接着上市卖。

哦，所以是在卖房？然后买家无法按时交割？卖家可以向买家追讨所有因为买家无法按时交割所造成的损失。买卖合约上有列明的。你让你的律师去办吧，不然请律师买卖房来干嘛

这我就不懂了。为啥没有交割？你说的“卖出去”是指确定unconditional后吗？unconditional后无法贷款或资金突然出了状况然后没法交割结果没卖成？

抱歉，是卖房子
约定的交割日过了也没有交割，买家的贷款出问题了，需要多一点时间。是不是需要先发通知给他要求他必须在期限内完成交割？然后期限过了以后才能取消合同？这个通知的期限是法律有规定还是随便填？

对的，就是买家资金出问题，也不是说不交割了，就是需要多点时间
但是想多了解一些情况，防止出现最差的结局

说错了，是42天通知。法律规定的。让你的律师去搞没按时交割的问题吧，你付了律师费的，或许得多加费吧。这里的人包括我都说不准，毕竟对这方面不是专业的。

你的情况应该符合以下两条：
When landlords can give 42 days’ notice
A landlord can give at least 42 days’ written notice to end the tenancy if one of the following apply:

the property has been sold and the new buyer doesn’t want tenants (ie the buyer wants ‘vacant possession’)
the owner or a member of the owner’s family is going to live in the property
the property is normally used as employee accommodation and its needed for this purpose. The fact that this might happen must be included in the tenancy agreement.

你没看清楚，fixed term的，在没有双方同意的情况下，是不能提前解约的。不是房东单方面给notice就能解约。

你那情况是在不符合任何我列出的那三个情况下不能提前终止合约。我是亲身经历过，给了我之前租客42天通知，因为国内家人过来玩需要地方给他们住。

那是因为你的房客没有去告你，并不代表这样没有违法。。。哈哈

看似这个是对租客的，我们现在需要终止购房合同，不过多了解也是好的

怎么能这么对待房东呢，签了合同就必须要执行么？现在是对方有过错在先啊

统一回复，律师给出的权威解答：
你可以在交割日过了以后（实际上是当天四点以后），给买家发通知，买家必须在12个工作日内完成交割。如果无法满足，那我就可以解除合同而且狮子大开口了。

还可以，我觉得还是比较人性化的，既照顾了买家也照顾了卖家。买家不至于因为一点点失误就招致重大损失，卖家也不会被买家一直拖拖拖拖拖拖拖，最多12天，过了就可解除了，而且定金归我了，还可以追诉合理的相关损失。

老鼠给你的答案是正确的

fixed term 不能提前终止（除非双方协商同意）。
你说的那三种情况都是 periodic tenancy （也就是fixed term 结束了的情况）。

你这次租客没说什么，但还是学习一下吧。
