这个Hsu-Yin Wei挺厉害的，懂得自己告老板，赞一个。。。嘿嘿

A travel worker whose boss threatened to jeopardise her work visa and refused to pay her what she was owed so she could see her dying grandmother has been awarded more than $40,000.

Hsu-Yin Wei was employed by ANZ Sky Tours in Auckland in April 2016 as an accounts payable and marketing co-ordinator.

ANZ Sky Tours sponsored Wei's work visa and agreed to pay a salary of $40,000 plus a bonus if certain targets were met.

In September that year the company's managing director, Sherry He, changed Wei's job description to include work as a tourist guide, and changed her payment from salary to remuneration based on a 10 per cent commission from sales. This was lowered, against Wei's wishes, to 5 per cent, then later changed to a base salary plus 2 per cent on sales achieved.

Wei repeatedly asked He to pay her commissions as she was in desperate need for money. Wei said when she asked for payment He would refer to her work visa. This made Wei nervous and she resigned on June 28 last year. She later went to the Employment Relations Authority claiming she had been unjustifiably constructively dismissed.

An investigation meeting was held in May.

Wei told the authority that the proposal to pay her on commission was put to her in a way that was not open for negotiation and she did not feel she had an option

He told the authority Wei's performance had been affected by a car crash she was involved in, and that she was surprised when Wei resigned.

In an email in December, 2016, after Wei expressed concern about the pay arrangement, He told Wei "I would like to inform you that I am considering not to support your further work visa, also the matter of permanent residency".

The email said He valued her other staff, but "You have been here long time. I do not have a such feeling to you. I suggest that you need to think carefully and make a plan for your future".

When Wei asked He about the wages she felt were owing He told her she was not going to pay commission and that she would be put back on salary. Wei said He told her that she thought Wei would have resigned after the change to her remuneration structure in late 2016 and reminded her that she could dismiss her anytime.

Wei resigned in June last year. She found work elsewhere in Taupō.

Authority member Anna Fitzgibbon did not accept He's version of events and noted that He had repeatedly reminded Wei that she was considering removing her support for her work visa and had not paid Wei the wages she had promised to pay.

"I consider Ms He's actions amounted to a course of conduct with the deliberate and dominant purpose of coercing Ms Wei to resign," Fitzgibbon said in a recently released decision.

She said Wei "suffered for a considerable period of time before resigning".

"She told the Authority she begged Ms He to pay her when she was in financial difficulty and wanting to travel to Taiwan to see her dying grandmother. Ms He was not sympathetic towards her," she said.

She ordered ANZ Sky Tours to pay unpaid remuneration of $18,146.47, $20,000 compensation for humiliation and loss of dignity and $2,806.85 in lost remuneration.

这两个工作title的差别也太大了吧。
老板不可以随便不经过同意就给员工乱换title吧？而且对于薪水差别也很大，这很明显就不公平呀
被罚也是活该啊

华人公司有猫腻的太多了，欺负员工，随便哪一个员工去劳工局告一告，都是一告一个准的。
