Hi, I'd like to ask if anyone had the same situation like I have now? If so, what was the outcome?
Ok, here is the story. It happened this morning.
Before and during the process I was reversing my car from my house, I was 100% sure that there was neither cars coming from or parked at either side of the road. After I already reversed to the other side of road, all in a sudden there was this red car (FJA309) behind me and I ended up hitting it. Is it my fault? I thought the red car should have kept a safe distance from me as I was already on the other side of the road. However, she rang the police and told the police officer that she was stationary when it happened which I extremely disagree of.

I had car accident before but have never seen one with such terrible attitude. If it was my fault, I would definitely admit it but I strongly believe it is not my fault this time. Well, I guess it is up to the insurance company to decide then since I have no witnesses :(

绝对是你的错，不过你要和她扯皮谁也没办法，很可能end up各修各车

Unfortunately I don't think the law is on your side. You were pulling out of a drive way in reverse; you reversed across the centre line; the other person has right of way and was travelling normally or stationary (disputed point).

I don't see any point supporting the other party being at fault or has liability. Unless you have indisputable evidence that the other party is at fault or was doing something wrong it's not looking good for you.

I understand if you a hit a stationary car then it's 100% your fault.
But I was already reversing out AND on the other side of road as well, I thought the safe distance rule would apply to her. No??
What a grey area!

LZ倒车撞的100%你责任不是你倒之前看了没车就可以放心大胆的倒的倒车时得随时注意后面路况的速度不能快

还有你在倒车你又如何能要求别的车子保持安全距离？莫非要后面的车子也往后倒车？

首先你在倒车，倒车造成事故的除非你能证明她是故意撞你的，基本都会断定是你的错，何况她是stationary，至于她到底是不是已经不重要的，你倒车出driveway不管向哪个方向，出事故判断责任都很难向着你。

I thought the safe distance rule would apply to her because I was already on the other side of the road and ready to drive ahead.

没办法证明是她的错导致的撞车，倒车出车库的一方赔，保险公司不会为你去争的。警察也会认为是你的问题。认倒霉吧，下次争取倒车进车库，车头冲外出车库。而且你也说了，突然她就出现了，说明你也没一直观察后视镜，连她的车什么时间出现的都不清楚。

most likely you case may come out as "no decision"; unless witnesses involved, which means either party needs to cover their own liabilities.

不對！案例：你停在紅燈前第一輛車；後面的車撞你，也給你駕照了，也寫了書面聲明是他撞的。上了法庭說當時他受到暴力威脅，才寫的，還說你在紅燈前倒車把他撞了。仲裁庭判決： No decision (無法界定），各自賠償各自的損失。

2. on the time of the hit. are your car fully on one side of the road or the car is still crossing over the mid-line.

无图无真相。
一般来说保险公司不裁决。

1.如果你无故在正常马路上倒车，你全责。
2.如果你一车横跨双向，你全责

I only took photos of her car, vof and driving licence.....
I was already on the other side of the road....was not on the centre line or in the process of crossing the centre line.
Anyway, i guess it is very hard that I will win given the feedback from you all here and I have no witnesses.
Preparing for the worst.

有证人你也赢不了，你从家里倒车出来的那个时刻，已经违反交规了。不管那红车是动着还是停着，你的全责。警察来了很可能再给你来一张危险驾驶，你倒车越过中线是很危险的。

Of course it is your fault according to that. That means you wasn't even watching nor paying attention the whole time during reversing, and therefore ran into it yourself. A car is not a ghost, it can't be behind you all in a sudden.

我不觉得对方车能瞬间移动。
“我没看到”不是理由。大部分肇事方都是“没看到”

你在主路上倒车撞到别的车，怎么撞都是你的错

你倒车倒到主路上就有理了？你是在倒车好吧被撞的成因是你倒车出来还在主路上倒车这个本来就已经是违反路规了更何况你从倒车转成前进到正常速度至少需要好几秒吧所谓安全距离也就2-4秒还是指两辆正常行驶的车辆你这能算正常行驶吗？让一个正常行驶的车辆和一个刚刚从静止起步的车辆保持安全距离还有点逻辑吗？

要，除了這些，還要拍照片，記得要把車，撞損的位置，路面位置，如果附近有路標（give way, stop, 雙杠線等）都要拍。最好就是手機還要錄音，把雙方的對話錄下來。

危險駕駛(dangerous driving) 是刑事罪刑。這僅僅是交通意外而以，頂多是不小心駕駛（careless driving)，但表面證據不成立。

你倒車出來的路面是不是雙黃實線？你倒車出來是否違例？（你當時是否有確認沒有車？），如果你都做了該做的事，那麽這是一起意外，而由於沒有人違例，基本仲裁偏向判決　No decision；也就是各自負責。
