大律师您好：
我在trademe上面卖了一个动物角雕刻的作品！（ trademe Listing #: 590134816）
我们是当场交易的（面对面进行的）当时买方对于此件物品非常满意并付现金给我。（购买当时他验看了将近半个小时对物品的状态和条件并没有提出任何异议）
（当晚发邮件给我）不知道他为何找了一个第三方的人（号称是新西兰专项拍卖公司的老板）说我卖给他的雕刻作品有缺陷因此强行要求要退货。我说物品已经售出我不同意退货，他就要去法院起诉我（还不是去小额法庭 Disputes Tribuna，而是去DISTRICT COURTl）我想咨询您我应该如何保护我的权益。

纠纷的关键是他和他找的第三方认为最小那只鹿的鹿角是有损伤的，但我认为那不是瑕疵是物件本身就雕刻成那样的。trademe交易页面上对于所有条件都写的很清楚了，而且有清晰的照片展示出所有细节。

放心，这种穷B，是请不起律师的
总共才3000，请律师打这种官司都不止这个价

这种个人交易，又不受CGA或者FTA保护，本来就是一手交钱一手交货的问题而且就算是瑕疵，那也不关你的事，本来二手买卖就是sold as is

既然是争议，那就必须有第三方仲裁
如果对方要退款，那就可以找第三方的鉴定机构出具这个馿角是后天损坏而不是先天制作
最后拿到仲裁顶多也就是上上Tribunal而已
总之是个很漫长很麻烦的事情
打死我都不信对方有那个闲钱时间上court

您好，如果你是个人行为买卖，消费者保护法并不受理。

个人之间的买卖只要你没有误导对方是不需要保证质量的。

同时，就算对方要告你，因为价值只能在disputes tribunal 受理，无法进入district court 的。

23 May 2013 补充 - LZ 我上面的回答绝对是正确的，只是我平常没那么多时间，所以回复的有点简单化了，这里我再补充一下。

1. 如果你卖的东西只是二手物品，你也不属于二手物品商的话，根据S41(1) CGA, 你的行为不属于in trade，你也不能被定义为supplier, 而你不需要根据消费者保护法保证物品的质量（acceptable quality），buyer cannot sue you for breaches under CGA. 同样，因为you are not in trade therefore Fair Trading Act (FTA）is also not applicable in your situation，whether the transactions were conducted through bidding, auctions or buynow functions, 除非你的言语上有误导的行为，因为虽然你不是trader，但是你和buyer还是有个人交易的合同关系，contractual remedies act would apply in the circumstances if misrepresentations were made to the buyer by the seller, allowing the contract to be cancelled.

2. 反之，如果你是在trademe上卖东西的商家，包括二手物品商家，CGA，FTA, CRA还有一些别的法律都可以适用。只是要注意的是online auction 现在有两种看法，有人认为做为商家，online auction 也属于正常auction的一种，被S41（3）CGA管辖，所以CGA不能适用。有人认为online auction 不属于正常auction because it is ranby computers, 所以S41(3)不能管辖，就是说可以被CGA适用。但是这只属于对online auction上的争辩，bidding and buynow 对商家来说还是需要被CGA 管辖的。

所以，我的结论是，CGA是否可以适用第一步是确定你是否是商家（supplier or trader in trade), 然后再确定你交易的方式，来得出最后CGA是否可以适用的结论，这个顺序不能颠倒，就这么简单。

Check your tm sales records, seems you are a professional trader.
If the seller is a professional trader, buyer still have the protection of the Contractual Remedies Act. But buyer also covered by the Fair Trading Act and, in some cases, the Consumer Guarantees Act and the Sale of Goods Act.
To get an idea if the seller is a professional trader, look at their previous sales. If they have several listings for the same type of item, or if they have sold similar items in the past, they are probably a professional trader. It doesn't matter if they think of it as a hobby or if they've kept their day job.

我是正常出售！我出售的不是普通消费类产品是古董 (antique), 古董是不具有使用价值的！古董的价值是艺术性和历史性。所以不太理解楼上说的话是什么意思或者请说出具体内容，我希望是与我的case有相关的信息。

簡單來說你近期在trademe所出售的主要商品是屬於古董類，那可構成你為professional trader 。你可能說這是個人行為賣買。但別人可用這個point說你是古董商人，因為你的圖片及內容非常專業。加上你在trademe主要出售古董。如果是professional trader 就好多法律責任要上身。如果不想給別人認定你是trader, 那你快點把不是古董的杯碟舊衫舊鞋$1reserve放上trademe。這樣你在trademe 的sale record不會這麼明顯你主要出售古董。就不構成你是professional trader.

我只是卖个物品，我觉得antiques和新产品还是有很多区别的！
第一个是antique没有太多的使用或者说实用性，所以不存在质量问题和售后服务。
第二个是antique有保值或者增值的作用，普通商品不具备此条件。
第三个我也不是专业卖古董的，只是把家里以前收集的卖掉！因为家父不想玩了。（看我的积分就知道了，专业的销售不会只有那么少的积分）

LZ我熟读Consumer Guarantee's Act

因为你的东西是通过buynow购买的，所以CGA是cover的。这个你可以自己看CGA的具体条款，上面有专门讲online trading的。就是如果东西是faulty的，你需要给他repair 或者replace.或者refund.

但是，他亲自检查了这个物品很久，他有权当时找出问题然后不付款买这个东西。但是他当时仔细检查并且付款，就证明他已经接受了这件物品完全没有问题。你完全有权利说你不退款给他们。

LZ如果你确定这个东西卖的时候没有问题，你就直接告诉他，你自己亲自验证了那么久然后满意之后才交钱的，现在不可能给你refund。CGA里面明确说了你不需要给change of mind退款。而且他拿回去之后，很难保证这个不是他自己弄坏的，比如不小心撞了，掉了。然后赖在你头上。即使到了tribunal，你一定要说，他当场检验了超过半个小时满意付款，之后你不能保证不是他自己损坏的。

他不可能找律师告你，这人是一个SB.
这种私人买卖纠纷只能去Tribunal，District Court会把他踢出去的，所以他在说谎，但是在Tribunal，你可以明确说明他当时看了半个多小时，并没有问题满意付款，之后拿走了损坏就不是你的问题。

这个跟professional trader没有太大的关系。
主要是看到底是bid到（auction sales)的还是 buynow的。

Know what laws do and don’t apply

The Fair Trading Act applies to auction sales. Auctioneers must not misled or deceive bidders as to the service they offer or the goods for sale.

Auction sales are not covered by the Consumer Guarantees Act
You do not get the same level of protection when you buy at an auction as when you buy in other retail situations such as at a store.

Goods bought at auction may be subject to the Sale of Goods Act requirement of "merchantable quality" which means the goods should do what they are supposed to do and be of reasonable quality given the price.

But this protection can be removed by the auction house. There must be a sign displayed, or a statement in the sale catalogue, or a verbal statement made at the auction that the Sale of Goods Act will not apply.

Generally, an auction is the process of buying and selling things by offering them up for bid, taking bids, and then selling the item to the highest bidder.

There are two common types of trading that typically occur in online market places. The first is where the seller offers goods for sale at a specified price, followed by subsequent acceptance by the buyer of that offer. Many New Zealanders refer to this as a “Buy Now/Confirm Purchase” transaction. The second form of transaction in online market places is what is commonly known as an “online auction”
(referred to in this discussion as Trade Me style auctions, so named after the popular website).

这段话也是你发的那个link里面的，她把online trade买卖类型分成两类，第一类是buynow/confirm purchase(这个说得就是fixed price offer).第二类就是online auction就是通过bid买到的那种。

There is an inconsistency in consumers using an online market place having the benefit of the guarantees in the Consumer Guarantees Act if they make the final purchase by way of the Buy Now/Confirm Purchase button73. A good may be offered for sale on the online market place by Trade Me style auction (and therefore the Consumer Guarantees Act does not apply on the basis that the good is being sold by auction or competitive tender) but if there are no bids and the same good is then offered and sold under the Buy Now/Confirm Purchase transaction method, the protections under the Consumer Guarantees Act then apply for the same good.

律师这个不用我翻译了吧，她第一句话就说了虽然是有争议而且自相矛盾，不过也说了如果你是使用buynow/confirm purchase，是有一些benefits的啊，意思就是CGA会cover的哦。他也说了自相矛盾，如果bid到的东西，CGA不管，但是如果buynow的东西，CGA是 apply的呀。所以通过buynow购买的东西，CGA是cover的！而且tribunal也是这么判决的。

反正是Auction虽然CGA不cover，但是你也是必须要按FTA说得来卖东西。意思就是不能骗人。

你后来发的trademe的那一段话，他们是准备把现在trademe那些CGA并不cover的auction类型（不包括buynow因为buynow本身已经cover了）的想办法让CGA来cover,就是上面的第二类型！第一类的buynow原本就是CGA已经cover的！律师要不您再仔细读读？

这里说的是trademe style auctions，没有说buynow！因为前面说了buynow已经是CGA applied的拉

而且跟那个Consumer Affairs 的 Julie 也聊过，虽然她只是 service leader不是律师，但是还是大概这么说的。

律师你没看电视么？而且应该从来不用trademe的吧？
有一个人用buynow买了一个二手的室外桌子，去pick up的时候，那个buyer说桌子椅子不是他想象的那样不买了，那个seller就把它告到tribunal。seller当时把桌子还有一个椅子都抬到tribunal了。tribunal的调解人也看了trademe上面的图片和description.认为没有误导成分（就是没有breach FTA)。最后tribunal的判决就是，因为这个二手桌子使用buynow而且没有问题，所以根据CGA， buyer是必须要付钱购买这套桌子，因为tribunal说的就是，trademe上面的交易，无论是不是in trade，只要你用buynow，CGA还有FTA就cover。
虽然这个buyer不同意，还找了Fairgo，不过Fairgo也没能帮他。但是tribunal就是这样判决的。他们这个交易就是纯私人交易。那个卖桌子的只是卖自己家不要的桌子。

我唯一不太清楚这个桌子case的就是，那个buynow/confirm purchase有这么一句话，

说的是要从一个trader那里购买，但是那个桌子的case，tribunal判了那个buyer需要付钱。我没有看那个卖家的资料，也许他多次/经常卖二手的花园桌子椅子之类的，所以被tribunal 认定为trader?电视上好像也没说

看你这个关于supplier的说法，那LZ看起来也是in trade,因为IRD也有规定，如果多次重复的卖同一种类产品以盈利为目的，就是in trade，需要报税。LZ的feedback有很多同类型的东西被卖掉。并不是清理家里不要的东西，一样东西一个两个那种。所以是in trade

律师，我引用的英文我完全理解，我现在反而有点怀疑律师的英文水平了。
我们的分歧就是你说所有trademe的买卖CGA都是不管的。这个是完全不正确的！！！！！！
我说的是bids的CGA不管，但是buynow还有fix offer的，不管私人还是公司以营利为目的重复卖同类产品的，CGA就是cover的。
我从一开始就把LZ当作一个in trade的来对待，完全不是你说的私人买卖！所以我根本没有讨论过LZ是不是私人买卖的问题，我一直在说LZ这个买卖CGA绝对是cover的。

我上面说了，这段话有标注。而且那个桌子的case，我没有看到seller的资料，也许那个seller经常卖二手的花园桌子椅子。但是tribunal的确是这么判决的。而且我也没有说错。in trade的话，CGA就是会cover buynow还有fixe offer的。

我说了那么大段都是在针对你这些不负责任的话。首先LZ这个买卖，CGA绝对保护。只不过这个buyer自己不讲理而已（这是我跟LZ说的意思）。
其次你自己发的那些links里面也说了，就算CGA不保护的那些Auction，还是要遵循FTA，不能欺骗buyer，所以你说不需要保证质量，完全是误导！

第一个 if they are buying goods or services for personal use。。。如果买来不是自用的话CGA是不COVER的
第二个 , and they are buying from someone who is a trader (not a casual private seller).这个是‘IN TRADE’的解释就是卖家必须是专业卖家不是偶尔卖私人东西那种

两种都符合了才可以

你上面写的有明显错误。。。如果买东西用BUY NOW不是PERSONAL PURPOSE比如一个商用咖啡机。。。那就不在CGA包括的范围内

对。不过那个桌子的case买家不是商业用途，桌子的那个买家我是跟她聊过天的。她不是买来商业用途，她是一个年龄不小的kiwi，买来自己放花园自己用的。我唯一就是忘记问，那个卖家是否经常卖花园的东西而被定义为in trade，所以tribunal这样判决。因为要符合这个判决，就是这两个条件。但是记得当时听起来的感觉那个卖家未必是。所以后来buyer才不服，要去找Fairgo，但是Fairgo并没有帮他解决任何问题。她最后还是要给钱买那套桌子。

商业用途那个也是pre condition，就好像前面我说的，我在回复LZ的时候，已经排除了这些，然后回复的。因为感觉那个买家并不是商业用途，如果他真是专业的话，也不会当时不看好了之后再找麻烦。

所有东西商业用途的都不包括，商店里面买的用来商业用途的也是，所以这个跟这个case完全没有关系

不过我针对的只是律师的误导，后来我特意把所有这些都翻译给了Consumer Affairs。他们也同意我说的，律师说的是错误的！

最后很善意的提醒你一下。小心IRD
因为你重复卖同类型的东西。而且数额不小。
虽然你自己感觉是个人用品，但是其实你还是应该要报税的，缴税退税是由IRD来决定。

我觉得你这位女士挺不讲道理的啊。

如果我需要私自编辑你的帖子来达到目的，我直接把帖子删了就好，还需要给你言论自由的机会吗？你再仔细看一下我编辑你唯一的一个帖子是否有删除或者改动你的原文？我只是针对你说的话在旁边用红色加了一个小小的回复而已，绝对没有改动你帖子里任何的内容。

同时，你开口闭口说我误导，请问我哪里误导了？我删除和你的辩论是觉得没有意义在网上和网友针锋相对，而且你在法理上有一些见解是不正确的，我看过你之前给别人回复，什么绝对不要用华人律师，我觉得你太主观，和主观的人很难讲道理，因为主观的人就算错了，也不会承认的，而且很喜欢乱给别人扣帽子。其实我删除自己的其中一个帖子中有很仔细指出为什么你写的很多东西是不严谨的，不过后来我想，你又不是律师，我又何必那么吹毛求疵呢？这才是我删除自己所有和你辩论帖子的原因，而不是因为我错了，你不觉得自己有些咄咄逼人了呢？

同时，律师不是圣人，当然会犯错，有时候我在政策上解释或者一些信息过时发现后会及时改正，我绝对不是那种错了一定死要面子说自己是对的人好不好。

如果你认为对错很重要，那么在你扣帽子之前，我建议你可以找个时间和我见个面，我会专业的指出我为什么认为你写的很多东西不是正确的，而且找出相关案例支持，而且同时让你知道不是所有华人律师都是在你想象中那么无能的。（我不会收取费用，纯粹是想让你知道你在这件事情上过于武断了）
