Exporters must be registered: All exporters of dairy products are required to be registered by MPIunder the Animal Products Act (APA) 1999.
o Thisapplies regardless of who owns the product at the point of shipment, the sizeof the export or the reason the product is being shipped. This includesinternet sales and gifts. The only exception is if the product directlyaccompanies you on a plane and is solely for your personal use.
· Dairyexports must stay within the Risk Management Programme Chain of Controls: All dairy exports must stay under the continuouscontrol of premises operating under MPI registered Risk Management Programmes(RMPs) from the point of manufacture to the point of export.
o Freightforwarders handling and storing dairy products (dairy material for the purposesof the Animal Products Act) for export must have a registered RMP. A recognisedanimal products verifier must carry out regular verification of the freightforwarder’s RMP. Verifiers are recognised in accordance with standards andspecifications set under the Animal Products Act. Verification requirements arefurther detailed in the Animal Products (Export Verification Requirements)Notice 2011.
o Freightforwarders must also comply with relevant requirements of the Animal Product(Dairy Processing Specifications) Notice 2011, the Animal Products (Export Requirements– Dairy Products) Notice 2005 and Animal Products (Official AssuranceSpecifications – Dairy) Notice 2011.
o Productpurchased at retail outlets, stored in premises without an RMP and ortransported or handled in any way except in accordance with an RMP (or atransport firm operating under the relevant Regulated Control Scheme (RCS) fortransport) is ineligible for export.
· Exportsmust comply with Notified Export Requirements: All dairy exports must meet any MPI notified exportrequirements (as made available to all registered exporters).
o Theseinclude requirements that apply to all dairy exports as well as requirementswhich are specific to the intended market (Overseas Market AccessRequirements).
o Dairyexports that require Official Assurances (MPI export certification) have to beproduced consistent with the requirements for that export market.
o Alldairy exports to China require export certification. There are noexceptions.
o Toreceive export certification dairy products require a Summary of Records (SOR)declaring the production lot is eligible for that market. This SOR mustbe to be submitted by the manufacturer to MPI’s Dairy Certification Unit.
· AccurateCustoms export documentation: Customsexport documentation must be correctly and accurately filled out and submitted.
o Cannotbe described as personal effects unless you / the party are emigrating.
o Must bedescribed as infant formula if the product is in consumer ready packaging andlabelled as such.
o Goodswith a free on board (FOB) value of $1000 or greater MUST be reported on anexport entry.
Under the APA, an exporter is a person who exports any animalproduct from New Zealand, whether or not for reward or for trade.
As well as being registered, all exporters, amongstother things, have a duty to export dairy product which meets the relevantanimal product standards, specifications and export requirements. It isimportant that non-compliant export activities do not negatively impact uponNew Zealand’s reputation and wider economic interests. New Zealandmanufacturers and exporters can meet overseas demand through legal exports ofcompliant product.
You should note that even if your operations arecompliant, the dairy product (dairy material for the purposes of the AnimalProducts Act) you handle may still be ineligible for export if other parts ofthe supply chain (from manufacture to the point of export) are not compliantwith the legal requirements summarised above.
