邻居的房子委托中介出租给了租客，租客的一访客将与我们相邻的一侧ＦＥＮＣＥ开车闯倒了，那个人当时就跑了。我们叫了警察，警察说暂时还没找到此人，叫我去找保险公司。本以为先出垫底费房屋保险会帮我们完全修理好ｆｅｎｃｅ，等警察找到肇事者，保险公司在帮我们要回垫底费。

可是一个星期后被告知，此ｆｅｎｃｅ是与此邻居共用的，保险公司只ｃｏｖｅｒ一半修理费。与邻居房主联系，他让我们找中介，找到中介商量共同出资修，他拒绝了。他的理由是，不是他的责任。他的租客也说该访客是不请自到的，也极力摆脱干系。现在警察已找到了肇事者，要上庭了。现在我们该向谁来要那一半的修理费呢？该如何操作呢？谢谢了！

No. They were responsible for the damage, and they have to pay.

Who is responsible for the repair of boundary fences?

This depends on the circumstances. The occupiers of neighbouring properties split the cost of work on boundary fences unless there are contracts or covenants with contrary agreements, or if the parties previously agreed to other conditions.

If the fence is damaged or destroyed by one party, then that party has to pay for all of the repairs. If one party wants to repair the fence out of their own pocket, then they can.

WHO IS RESPONSIBLE FOR WORK ON FENCES?
(Fencing Act 1978, s.9)

The occupiers of adjoining properties must share the cost of work on boundary fences equally, unless:

(Fencing Act 1978, s.17)

one of the property occupiers damages or destroys a fence, then that person must pay the whole cost of repairs.

我觉得你如果不嫌麻烦，可以把他们告上Disputes Tribunal, 可是毕竟是邻居，有点。。。

要不就跟保险公司说说应该是他们全修的，让保险公司去追

撞的人，就是个小混混，没工作，看来也没钱陪我。我才去ＣＬＡＩＭ　保险的。谁知道因为是ＢＯＵＮＤＡＲＹ　的，保险也只付一半的修理费。
交涉多次，邻居不出面，全权交给中介，他们就是不答应出一半的费用，一副事不关己，不闻不问不管。看来注定要上ＴＲＩＢＵＮＡＬ了。
