我是租客 最近房租到期了 (当初搬进来有跟agent签合同)

但agent都没来谈续租的问题

对我来讲是有利还不利?

我都按时缴房租 从未迟缴

想续租 怕agent某天忽然来教我搬走

有些租约是到期了直接转成periodic的,你看看你签的那份是不是?

如果是的话,那就是你要搬的话给中介提前3周通知,房东要你搬的话,要给你提前6周还是3个月(这个忘了)通知

一般来说自动转成periodic
或者你找中介问问吧,中介估计忙把你给忘了

房租租约到期了就变成periodic了,你什么都不用做。

如果你想走人,那就给3个星期notice。

如果房东/agent叫你走,那要90天notice。

刚契约完整看过了

(就一张A4的纸 其中泰半还是写我个人资料 周租金多少 等资料)

貌似没有转成 periodic Tenancy 的条款
也没有 想搬家 双方要多久之前告知的规定

那我现在的租约是否变成不固定的啊?
就是房东只要按照法律规定的期间提前告知就可以叫我搬?

因为我想跟房东签长期的

A fixed term tenancy automatically becomes a periodic tenancy on expiry of the fixed term, unless either party gives notice they do not want that to happen. This notice needs to be given no sooner than 90 days before the end of the tenancy and no later than 21 days before the end of the tenancy.

There are two basic types of tenancies: periodic tenancies and fixed term tenancies.

What is a periodic tenancy?

Any tenancy that is not for a specific term. This is the most common form of tenancy. It continues until the landlord or tenant gives the appropriate notice to end it.

To end a periodic tenancy a landlord can give a tenant a minimum of 42 days’ written notice if:

    they have an unconditional agreement for sale and purchase of the premises that requires vacant possession be given to the purchaser.
    they require the property as a principal place of residence for them or any member of their family. This cannot be for a holiday, a weekend retreat, or to renovate the property while retaining a home elsewhere.
    they wish to use the property to house an employee and the tenancy agreement with the tenant states that they might use the property for this purpose.

The reason must be included in the notice.

In all other cases the landlord must give the tenant a minimum of 90 days’ notice to terminate a periodic tenancy. No reason needs to be given to the tenant in a 90 days’ written notice to terminate.

If the tenant wants to end the tenancy, the tenant should give a minimum of 21 days’ written notice, unless the landlord agrees to accept a shorter period. The tenant cannot be required to give a longer period of notice, regardless of what may be in their tenancy agreement.

原來 periodic tenancy 是指沒有規定期限的租約^^

变periodic 以后,房东要涨租金也比较容易

一样的啊,只要放合适的clause进和约,都可以每180天review的。
