File sharing
We recommend that the definition of file sharing in section 122A(1) be amended by including reference to downloading or uploading material using networks or applications that allow material to be shared among multiple users. This would avoid inadvertently capturing activities such as emailing or downloading that did not involve file sharing; if such activities breached copyright, they would be actionable under existing provisions in the Copyright Act.

THE LAW
* Rights holders, such as a movie studio, will alert an internet company if a customer is suspected of pirating material.
* An internet company will issue warning notices to the alleged offender within seven days, which the suspect can challenge.
* After a third warning, a rights holder can take a suspect to the Copyright Tribunal, who can issue a fine of up to $15,000.
* As it stands, an offender cannot have their internet connection cut off, but the Government may introduce this if the new regime does not stop piracy.
* The law comes into effect on September 1.

HOW IT WILL WORK

Copyright owners alert ISPs to a user who is downloading material such as music or movies without paying for them through file sharing.

A warning letter is mailed to the user by the ISP. If the customer does not stop downloading after three letters, the copyright owners can take a claim to the Copyright Tribunal.

The tribunal can give a maximum fine of $15,000 to the internet account holder.

Internet service providers can charge a $25 fee to copyright holders for every complaint notice issued under the Copyright (Infringing File Sharing) Amendment Act 2011, which comes into effect on September 1, Justice Minister Simon Power revealed yesterday.
