您好,如果是属于错误的合同,您可以直接要求退回租金,因为双方在合同上的intention 是错误的,而合同并没有正确的纪录双方的意愿也不属于住房性质,which makes the contract unenforceable.
如果对方拒绝,您可以通过disputes tribunal 要求退租金的。不过在索要租金的时候切忌说这是resiential tenancy agreement, 因为tenancy tribunal has exclusive jurisdiction in dealing with all resential tenancy matters however, it would make it repugnant to justice to have these matters heard in the tenancy tribunal.
