it really depends.

Most of the malls have explicit rules re photography inside their shopping mall. A lot of them have the rules written on the entrance doors.

They are all different, but generally, it's a big no no if you disturb other people or taking photos of the shop/their products.

For example, if you use your cellphone or a compact camera to take photo of yourself, your family in front of their christmas decoration, you will be fine.

But if you take a big DSLR with big lens and taking photos of random people or shops, you'll likely be told off by a security guard or shopping mall staff very quickly.

Even if you are hired by one of the shop to take photos for them, unless you are only taking photos inside the shop, you'll most likely still need to apply for an approval from the shopping mall management people or they won't allow you to do it in the shopping mall's common area.

yes that is very true... if you take photo of a person, you need a model release form... even if it is a small children...

just to know, the term "model" is not just professional model but any person used as a subject in the picture...

taking photo in any building require approval from either the owner or management, this is for security and copy right purpose, this is true and not a joke...
check this link... http://www.dailymail.co.uk/news/article-505649/Couple-banned-life-shopping-centre-branded-terrorists--taking-photos-grandchildren.html

I took some pictures in Greenlane Clinical Centre Operating Room (academic purpose) and I have to go thru 2 managers before I can even start clicking...

And due to the agreement, pictures are used for academic purpose so I cannot show it at other places without approval of the model, in this case, the nurses and etc...

Actually, this is not 100% correct :)

if the person is in a public space, you can take photos of him/her without his/her permission.  Only when you want to publish the photo then you'll need a model release form signed by them or their parents if they are under 18

yes you are right yellowS15, apology I missed out the most important factor that if you are selling the picture, u need model release...

for taking picture of kids, would be best u ask permission from their parent even if it is for personal or business... as i had been approach by parent once that they would not want their children picture taken, they have the right to do it... so best to ask first... i delete the picture in front of the parent that time...

Xav is correct, if the person is not clearly identifiable  in the photo, e.g. face not visible, too small, large group photo...etc  then there is no need for a model release :).

technically/legally speaking, as long as they are in public space, then the parents don't have special rights for not wanting photos of their kid taken by other person. But i strongly agree with you, if someone tell you they don't want their photo taken, doesn't matter if he/she is an adult or a kid, we should really respect them and don't take their photo or just delete their photo immediately.
It's just a photo afterall, and if we want people to respect us (photographers), we should respect other people too. {:7_336:}
