我先来：

1  在 exempting terms 里面，
  “If there is a breach of contract or if some tort is committed, the innocent party will not be able to sue succefully." 这个指的是negligence 之类的么？

2  under  CGA, " no contracting out except for business transactions"
   怎么去阐述它是不是 business transactions？

3  business purpose 可以判断CGA适不适用，但是如果不适用的话，就不需要考虑CGA是不是可以contracting out。。。可是后面的contracting out 也需要用到 business purpose 来判断，所以这个是不是重复了？

4  the Act does not apply to cases where goods are supploed by auction,
but if it is service, the Act must apply?

5  under CGA, section 7, if a reasonable consumer test can be applied , 是不是acceptable quality 就一定不符合？

2:公司买了个微波炉让员工用，这时公司是consumer,但是因为是公司买的，不是个人买的，所以卖家可以contracting out.
3:bussiness purpose可以判断CGA适用不适用，但是这个purpose是指有没有用来卖或者用它生产，如果买个微波炉让员工用的话公司就是Consumer了,如果是饭店用来加热食品的话就不行了。所以这俩个purpose不一样。

我很鬱悶...考試第一天...我有Comlaw 201跟psych 204....倒楣的要命.....
