标题: 1st of Feb is Public Holiday, right? help~~~~ [打印本页]

as title, my boss said it's not

i have to work on that day, just wondering based on the law, no matter how many hrs i work on that day, they need to give me another full day as day in lieu (coz i am full time staff), but i know for sure, if i work 4 hrs that day, they will just give me 4 hrs in lieu, that's mean it's worse than i take that day off.

what i should do,

1. Feb 1 is the public holiday

2.check your contract re. day in lieu

different companies have different policy.

现行法律holiday act 2003的规定是1。5倍的工资+ 1天的 lieu day.

If an employee is required to work on a public holiday, and it would otherwise be a working day for the employee they are entitled to a whole day's alternative holiday at a later stage.

The entitlement to an alternative holiday applies consistently to all public holidays including ANZAC Day and Waitangi Day.

This provision includes employees working shifts and some employees on call. Both types of employees get a full day off later, even if they only work for a small part of the public holiday.

But

Where an alternative holiday does not apply

An employee is not entitled to an alternative holiday when:

* they work on a public holiday that is not otherwise a working day
* they are on call on a public holiday but are not required to restrict their activities
* they are only employed to work on public holidays
* they are scheduled to work on a public holiday but are unable to work because of sickness or a bereavement.

i am full time worker, always work on Mon, company's contract states different from Labour Law, i don't know now..................

I suggest that you follow your company policy. otherwise check your HR.
