标题: 打架被要求上庭会坐牢吗？ [打印本页]

请问如果打架，最后要上庭，但是是初犯的话会怎么样？认罪以后会坐牢吗？不认罪的话会怎么样？多谢大家帮帮忙啊，不想留下记录~~ 这边的律师你不给钱绝对不告诉你一个字啊~

那怎么办？如果我不想留案底，还是不认罪继续往下打比较好是吧？郁闷了

樓主還是找個律師比較好，花點錢總比有案底的好吧，該怎麼解釋和上庭律師都會教你，而且不知道你的事件嚴不嚴重，還是要慎重考慮好啊。

如果你是初次犯的话是可以帮你申请不留案底的, 有问题可以和我们联系,看是否可以帮到你.

you need to make sure you dont have conviction before.

then you can be granted DIVERSION..

this is one time only JAIL FREE CARD....you wont get a conviction, (you dont need to mention this when you apply for PR)

talk to a duty solicitor for more details....

呵呵,警察同志, Diversion 并不一定只能做一次的,我就有客户得到了三次Diversion. 之前有Conviction也是可以申请diversion的, 如果Police Prosecution不批准还可以上诉, 不过麻烦一点罢了.

只不过有些Charges一般拿不到Diversion, 譬如有Mandatory Disqualificaiton 类的Traffic Offences.

多谢两位，只是说得我晕忽忽的，能说得简单点不？我不想留案底，是应该跟警察说情还是怎么办啊？只要是不留案底，认罪根不认罪我都可以阿！只是好像这个市法官说的算把？我以前没有犯罪记录。

for most of people, diversion is once in a life time...in some rare case, yes, diversion can be granted for multiple times..eg....a guy got charged with disorderly at 1990, diversion....same guy got charged with careless driving in 2000, diversion...2009 same guy got charged with breach lique ban..diversion...all minor offence and time between offence is very long...i remember min time frame between offence is atleast 5years or 6years...(I am not a prosecutor, so i dont know the exact detail)

circumstances apply....but the way you explain it, is very easy to mislead people to believe they can get diversion more than once.

diversion is USUALLY once only...sound better ?...but for MINOR offence only....

for LZ....fighting is minor offence, you will qualify for diversion, but you need to ask for it just to make sure you get it, (incase the prosecutor wasnt too bright...), you may qualify for duty solicitor, goto Auckland District Court 2nd floor and ask them about it....fighting...minor case la..

打架没事的，我留学生的时候因为打架进去警察局过好多次，上庭也好几次，最后都没什么事情，找个律师交点罚款。对以后PR申请CITIZEN申请都没有影响到

这个我知道：我老公也有过类似经历。打架是双方责任，如果没有重大伤亡，直接认罪。新西兰法律第一次可以认罪。而且不留案底。移民都没有影响。绝对不胡说！但是手续要找律师帮你办，不要乱来。但是每个人就只有这一次机会。
